Seems to be ambiguous number when looking for any legal guidelines.
I have heard that can legally limit to 2 persons per bedroom plus 1.
Is that accurate???
If not, is this issue that is determined by federal, state, or city legal parameters??
Seems to be tough to get definitive response from lawyer, government or anybody.
Almost as if they want to leave it intentionally ambiguous so as to always be able to threaten landlord with violation.

The 2 plus one is just a common phrase. Sec8 might use this but I don’t have to. I always ask “Where is the plus one supposed to sleep??”
Occ limits are what YOU set in your WRITTEN SCREENING CRITERIA.
Check your Health Code. Indiana says a bedroom must have certain features (a window that opens, heat, elec light, and locking door. Closet not required. ) and minimum 70sf for one person, 120sf for 2 persons.
So measure your bedrooms.
You can reduce the number of occupants by knowing the sf AND you can convert a BEDROOM into a DEN by changing the knob to non-locking.
My criteria says 2 persons per bedroom as allowed by sf.
The key is to apply this CONSISTENTLY to every application.

Here local town and city bylaws have the final say on occupancy limits where it is possible to go into website then print out all the local bylaws. Here it goes from federal to provincial then the town or city has final say in the bylaws. --99.236.xxx.xxx |

I have a tenant who started out as a single guy in a one bedroom apartment. Then he got married. Then a baby was born. I offered him a two bedroom but balked at the price.
