If you know someone renting your home moved an extra person in but when you confront your tenant they deny it and say they come once in a while but don’t actually live there but you know they do.

How would you go about proving it to them and would you raise the rent to let this person stay there. Other than this the tenant has been a really good tenant. --73.183.xxx.xxx

In 23 years of being a Landlord, I have yet to NOT have a tenant move in someone and explain they are only visiting. It happens all the time. I have started to just send a notice that there seems to be a 'frequent' visitor to the residence and I will be raising the rent to cover water charges, wear and tear, etc. Usually they come and explain and we come to an agreement about 'how long' and 'how much', or shall we add a new tenant to the agreement. You will never be able to prove they aren't there, but the threat of upping the rent usually gets action or the 'visitor' leaves pronto. --72.207.xx.xxx

If you were covering the utilities in a multi, and if you had a price difference between x occupants vs x + 1, then you might just raise the rent at the next rent increase to be your x + 1 rate, no explanation necessary, nothing to see, just an ordinary rent increase, yup...

If it's a sfh, I usually ask for the new person to fill out an application so that I know who's occupying the premises. If it's someone I know is Bad News, I'll put my foot down and say Absolutely Not. (I run into this problem when I have women coming to flee their abusers... but then want to invite their abusers back into their lives and under their roofs 3-6 months down the road.)

But in general, the only times I've had someone move unauthorized people in have been underage kids (high school kid who's besties with their own high school kid, and they're helping them avoid a troubled home life) or a case of bigamy, where she had specifically moved in to leave behind her old life, but ended up inviting him to come by and be part of the family life, but he genuinely did live primarily with his other family. --137.118.xx.xxx

Included in the "use & occupancy clause" of my rental agreement.

"If Landlord has reason to believe that there is an unauthorized occupant, the burden will be on Tenant to produce proof of this occupant's residency elsewhere."

This can be done by them producing (quickly - short deadline) a current utility bill or rental agreement in the person's name at another address.

You put it on THEM to prove this person lives elsewhere, not on YOU to prove they live at your unit.

If they give a rental agreement, check with the landlord. --68.229.xxx.xxx

3 ways to skin a cat!

1) Knowing from my tenants applications, I know the vehicles that belong on or near the property.

Then I'll find parked on the property or in nearby the same vehicle that the person goes to my

rental. Then I pay someone to take pictures of the car parked on the street or property.

2) I read the water, power and gas meters and see extra use meaning someone else in in the rental.

3) I set up a trail camera to snap pictures upon any motion. Then I review the memory.

4) I look at the magazines left on the porch or IN THE TRASH and find things with my properties address listed to a different resident, someone unknown.

Permitted Occupants: [NUMBER] in addition to named Renter(s). If Housing Provider has reason to believe that there is an unauthorized occupant, the burden will be on Renter to produce proof of residency elsewhere.

About 10 years ago I learned from a sec8 inspector to photo and count the toothbrushes, the person name you have to get with a photo of mailbox contents - Do Not Open, then you need a utility bill or lease agreement from another address, your lease should have the retroactive breakage clause. --76.188.xxx.xxx

Mike,

I like Blonde’s process. Just move forward and let them defend.

Our local Sec8 office makes them prove they have other permanent housing with a lease, utility bills, mail delivered to that address...

In real life I don’t worry about this. I’m all for additional rents but I have bigger fish to fry. We have some margin built into water usage. Some extra showers will not affect my bottom line.

I've read that on here previously and it's not very effective. Technically, I live alone. Count toothbrushes, Barbie towels, bedrooms that CLEARLY belong to children, kids stuff in every room and cupboard and someone is going to come up with a much larger number than one. --72.70.xxx.xxx

I use a similar clause as DJ, however it will be put to the test here if you move ahead to terminate tenancy over it. I have cameras set up. Judge wants to see the non tenant vehicle stay there overnight as proof they are living there. Time stamped camera works too. --68.191.xx.xx
