We have a 3 bedroom 2 bath singlewide mobile home for rent. It is 14 x 65 (outside measurement) Less then 910 square feet. We were contacted by an agency trying to place a family that had a home damaged by fire. So the response my husband made was he didn't want a short term rental.

He did ask the family size, and she responded, 5 children & 2 adults!

The smallest bedroom is only about 8 x 10.

Are we legally required to rent to such a large family because we have 3 bedrooms? Or does square footage enter into the equation? --71.219.xx.xx

You may consider the square-footage, and set a reasonable, maximum number of occupants.

HUD guidelines suggest a minimum size bedroom per person, which you can use in your reasoning if you want to.

As longs you make this determination before starting to screen people.

I have two 3bedroom homes that OC is limited to five cause the 3rd bedroom is very small.

If you do not do short term rentals than you do not. I do these rentals with insurance companies often...

I would not do this nor after viewing would they want to accept. Most likely due to square footage. --172.58.xx.xx

The magic HUD occupancy for a 3 bedroom is 7 people. 2 per bedroom plus 1 for the unit. Too bad yours is a 2 bathroom. This is why I don't take Section 8 or HUD placements, because of their rules. I've had to convert my 3rd bedrooms to a den by removing the closet. So it's only a 2 bedroom and I only have to take 5 people instead of 7. (When I say removing the closet, I mean take out the standard door and panel the wall with a hidden release). --47.155.xx.xxx

Pat,

The biggest thing about Fair Housing is to be consistent and treat everyone the same, so have a written criteria for screening and stick to it. Mine states "No more than 2 persons per bedroom".

So that ends it right there.

Measure the bedrooms.

Indiana Health Code requires 70sf of bedroom space for one person and 120sf for 2 persons. I believe HUD uses the same numbers.

(I've never figured out where Sec8 expects that extra person to sleep! My first Sec8 inspector used the saying "And Granny sleeps in the kitchen". Really??)

Your 8x10 bedroom = 80sf so it will only allow one person.

Insurance: Can be great with high rent for short term. But be careful! Screen normally. MANY are not who you want in your home. Just because they need housing quickly does not mean they can care for a home. Curb the emotional appeal.

Send the enquirer a floor plan with the room dimensions. Ask if they feel this is suitable for a family of 7.

Of course you are always willing to show the dwelling to anyone who is interested in renting. You have already made a potentially big mistake by asking about the family size. So you need to make it look like you would rent to them if they deem it acceptable. Frankly, I think you may have stepped into a land mine. It sounds too much like a fair housing test case.

I would want to know what the cause of the fire was. If it is one of those little munchkins being naughty I would be very concerned. --70.16.xxx.xxx
