Relinquishment of Possession

On this day xxx being of all the tenants of the apartment known as xxx hereby relinquish possession of, having no intent to return to the said apartment, to the landlord.

I acknowledge by doing this I not be able to enter the apartment again without the consent for the landlord.

I have removed from the apartment all of my personal possessions, and I understand that anything left in the apartment will be disposed of at my expense.

I have returned all the keys to the apartment to the landlord.

At this point I customize it to let them know:

-shut off specific utilities

-forward mail

-if they are breaking the lease a clause about them continuing to be responsible for rent until it is rented

In order to get the most money returned, the apartment should be in the same condition it was in when possession of the apartment was given to you, reasonable wear and tear excepted. Security deposit return accounting and any surplus money will be returned in one check with all names.

I use this at the end of every tenancy. I think we came up with some basic language in my landlord group the year a law on abandonment passed. I have tweaked to meet my needs. It was not created or reviewed by a lawyer. --75.67.xxx.xxx
