You CANNOT charge any deposit for ESA.
You can & should ask for ESA documentation.
Check your State HUD website for the rules regarding ESA's.
The federal level has their own requirements, but your State may have stricter rules.
I'm in California and I use Nolo dot com for my legal books & some legal information.
There is some good information on ESA certification on their site.
When I have had inquiries regarding ESA's I tell them I need their ESA documents for my Landlord Association legal department to review.
So far no one has followed through.

Verify with your city/county on requirements for vaccination records - that will likely be a photo vet record then you must be sure what the animal story is - there are 3 versions and they each go different directions. Many who are active here are now simply building animal damage deposit and rent into the rent in general, fewer headaches trying to do what you are now doing. --76.188.xxx.xxx |

To share my bad experiences:
Make sure, before they sign the lease, you know they have an ESA or two. Sorry to tell you, the tenant lies and wants to get your sympathy first, then they show their true color after they signed the lease.

A quick home visit will say wonders. Does it stink? Is the poop cleaned up? Fur messy? It will also tell you more about the people. Ask the LL as well. --73.230.xxx.xx |

No deposit, no pet rent, no veterinary requirements except that you can insist upon proof of the rabies shot.
You can not have an age limit, or a breed limit, or a species limit. You can not require neutering.
You should ask for the documentation, but must accept a mental health care provider who is online and out of state. The documentation does not have to come from a doctor, it can be any mental health care professional, up to and including their priest.
You might be able to get away with requiring a dog license if you live in a county where all dogs are required by the county to have dog license. --76.178.xxx.xxx |
