I think I may need to add a new written disclaimer on my application. "documents will not be returned to applicant". I've now had two different groups ask for this back after they were DQ'd. The latest one is demanding a copy of her background check, as well as the paystubs being returned...uh huh.

I speak from little experience but blocking them in this case may get you sued.

I don't see anything wrong with making a copy of what they turned in and paid for. I would give them a copy of the background check as that is public record. I would make a copy of the documents they turned in and give them back the original as they will need those for the next place and they should have only given you a copy in the first place. My tenants gave them by email or text. Now, the credit check you may need to have them request a copy from the credit company. That I am not sure. --73.120.xx.xxx

My applicants always have a copy of their backup as I have them upload it to the Google form I use for applications. They always have their originals. The service I use for credit checks bars the release of the credit check to the applicant. I don't get their ssn until they complete the W9 for the SD account. I never take originals of their "proof" other than the application itself. They do not get that back - we have to keep that by law since it could come back to us in some way, shape or form. If they only have originals then I would scan it with my phone or if I'm in the office, etc I would take a copy.

As for the credit reports or background checks - they don't get copies of that. I'm with Ken NY on this one ... I think it's against the law to provide them anyway - they have to request the copies from the agency that provided it, not us. --67.242.xx.xx

Plus - sometimes the background check comes back "OK" but if you call an ex landlord or whatever ... that's YOUR information, not theirs. I would NEVER tell anyone that I called so and so and they gave you a bad reference. I just make it generic and it's even better if you have more than one applicant and can just state "We've chosen a different applicant" ... then we didn't really DENY anyone ... we just chose a different one. --67.242.xx.xx

Some applicants that got turned down request the return of their supporting documents. I can understand, but I still make a copy for myself. A couple of rejected applicants reported me to different agencies and city departments, thinking I can' back up my decision to reject them.

I told the case workers I first need a release from the applicant before I can provide my explanation and possible proof. In once case I found myself in front of a Housing Committee. Again they wanted to to violate my applicants rights and disclose my reasons. So I responded that the applicant lied on their application, provide a bank statement belonging to their parents and changed the account holders name and social security to make it look like their account. Also their ESA letter was a fake! And finally they said their job was full time but their boss says they only work part time and their pay stub was also a fake. I can show you all of these items, when the applicant signs a okay to release document. --47.155.xx.xxx

I did make contact with this person. It turns out I screwed up and took an original pay stub from her (the male gave a photocopy).

I offered to mail it back to them and then this turned into a demand that I refund her application fee. She's irate because the male received an adverse action letter but she didn't get one. She keeps referring to that AA letter as a "background report". --72.188.xxx.xxx

the main concern here is information you as the LL compiled and returned to T, which then somehow gets loose from the T,....or worse yet is re-used by T with another potential LL and then comes back to bite you as the LL.

I make it clear in the application cover letter that no doc's submitted or compiled by LL are returnable or forwardable.

Many jurisdictions are now ""allowing"" applicants to furnish their ''version'' of their credit report, to save the portion of the ''allowed maximum application fee''.

unfortunately,...we LL's just have to grin and bear it,..and run proper checks on our own dime. --172.250.xx.xxx
