I find this on the NYS site about ERAP program.
"Not evict the household on behalf of whom the ERAP payment is made for reason of expired lease or holdover tenancy for one year from the receipt of the ERAP payment. An exception to this requirement shall be made if the dwelling unit contains four or fewer units and the property owner or owner’s immediate family members intend to immediately occupy the unit for use as a primary residence. "
Does that mean you can't evict for ANY reason for 1 year after you except the back rent? --66.30.xx.xxx |

I don't believe there is anything about giving a "20 %" discount but you do have to "waive any late fees" associated as apparently the gov't doesn't pay those (and you cannot charge the tenant the late fees either).
Read the entire thing about the ERAP payment agreement not just a section of it. There are rules but I'm pretty sure that you can still evict for non-payment - in the future, just not for the past (as an example, they don't want you to get "caught up" and then evict the tenant ...).
If you read just what you copied above - it is "clear" that if you are not in a lease with the tenant or you have asked them to move out and you take the ERAP payment, then you cannot just turn around and say "hey, we no longer have a lease ... get out". My suggestion would be to get them in a month to month agreement (signed by all parties), do what you have to do and if they break any of the lease provisions going forward, then you do what you normally would do. --67.242.xx.xx |
