So I get a call that a tenant has told another tenant that if his bath floor isn't fixed rt away he will burn down the building
(We have sent 6 handymen/contractors out and they say they well be glad to work on any of the other units but will not work in that one because of the tenants there
The local police do nothing about the noise and other complaints/ (small town police force of I think 2-3 part police.)
What would you do? He claims we can't evict them as he has made a complaint to the BOH and any attempt would be retaliation.
The other tenants there are scared to death and want to move.

I have been listening to upstairs battle it out. It has been brutal. I am a shaking mess...nothing new. I can nit handle this much longer. You have no idea how scarey and how awful it is....especially when I have lived in an abuse situation.
To top it off I now have to worry about Tony burning down the apartment (according to Gerry, Tony stated if his bathroom didnt get taken care of he was going to set fire to the building). Welllllll, if I thought I couldn't sleep before.....forget sleeping now. I guess I will end this email and go back to listening to them scream and yell....slam doors. I wish yoy could hear in person how loud and horrific this is. ---

I had one neighbor tell me if I placed a certain race of people in one of my rentals he would burn it down. He said it in front of my maint person. Called police and he was arrested.
Here is your problem. If you do nothing and HE DOES burn it down---AND YOU DIDN'T REPORT IT-- you'll be the one brought to jail. You'll be the one blamed for not telling others in the building about the fire threat.

Try to contact a landlords association where google to find. Local landlords association will be provide important legal help in the matter as this is serious. Found in the past when had to deal with insane rent control system in the province of Ontario a landlords association was able to refer to people who were able to help. There was serious fire in a rental complex in Oshawa Ontario where in the past there was a problem in the end rental unit where last week there was a fire where fortunately the apartment building had a working central fire alarm system where tenants left the building. Now some tenants are homeless where if that tenant was evicted this would not happen. Those tenants with damaged rental units did not have contents insurance where the contents in the apartment are a total loss. As a somewhat side note, back in the early nineties, one of my landlady colleagues said "go ahead and do me the favor" to her tenants who threatened this after being evicted.
She owned mostly C/D properties and before this one of her tenants accidentally burned down one of her SFH by starting a fire in the basement when the heat went out during an ice storm. The firefighters told her "You won the insurance lottery!"

Sadly I have an empty place nearby that was broken into and the houses on both sides also, we found rubber gloves which will be a good source for DNA but with all the jumble about police brutality they have not came to visit any of the houses for over a week, this is also an election year for many city officials, I complained to my local council person asking if we are now going under order of martial law - who will gather DNA when the citizens are the ones taking control? Called it in, cops did nothing. 2 weeks later, building caught fire and the evicted T and his buddies were at the building. Guess who they tried to blame for the fire. This is a BIG DEAL. Don't let the authorities bury it. Out here attempted arson of an occupied structure can be met with deadly force. It is a "big three," major capital crime. Murder, arson, kidnapping. In that order.
Ask about restraining orders. See about the other tenants getting restraining orders. Bring a lawsuit for emotional stress and suffering. Go see your doctor on that.
Get the other tenants to write or give depositions against him.
Hang in there we got your back.
If all else fails, I'll start polishing my shovel. ;)

Many, many years ago, I had an ex-tenant threaten to "Burn the B*tch", (meaning my complex) because of his dissatisfaction with my disposition of his security deposit.
I live in Los Angeles (also his new address, although different neighborhood), the property is in a small suburb with its own Police Force.
I called LAPD, spoke with the watch commander, got a call the next day that the Division Commander was taking the threat very seriously. Within a week, I got a call from some ADA, wanting to know about evidence (threat in writing, taped phone call, etc) who said that she would "invite" my ex-tenant to a District Attorney hearing. Such a hearing has no criminal status, it only serves to warn the invitee that he was "in trouble" and could serve to influence a judge if there ever was further action.
A month later my ex-tenant called up, begging (BEGGING!) me to drop "the charges" (he had claimed to be a Law Student at night), he was sorry, he meant no harm, please, please please...
The moral of my story is that Police will be hard-pressed not to do ANYTHING about such a complaint. There are, of course, evidentiary issues, but while Police are not responsible for Civil issues, they ARE responsible for criminal issues, including threats of violence.
I think that the justice system handles this one about right.

Good point, MYOB. I was thinking that a good insurance company might step in and prevent any kind of claim or disaster from ever happening, by demanding action. But you're right. An insurance company might also step back and cancel once they learn what kind of tenant is occupying the building.
Another thought is to possibly contact a local TV affiliate that has some type of "On Your Side" type of investigational reporting, that also wouldn't disclose the name of the owner or the property address. Maybe something like that would shame the local authorities into action.

I don't think that LAPD is different from other police departments. Neither is LA County DA's office.
I am very suspicious of those who say that their Police will not do ANYTHING about such a complaint. DA hearings are done all over the US as an effective tool for resolving potential criminal complaints where actual evidence of the crime is not available. That is, for serious, big-city Police Departments who are educated and know about handling crime more than just arresting low-lifes without evidence. Actually, I don't think that LAPD handled my problem any differently than any other professional PD would have done.

My lawyer who is supposed to be one of the best (according to our local LL association and several other LLs.
Doesn't seem to take this seriously no matter how I have explained it to him.
He keeps wanting the woman who the man who stated he would burn down the building to get a restraining order on him. I don't know how that would solve anything! ( except that the man might hurt her. that has been her fear to why she has not complained before)
He says if we feel threatened and don't want to do a restraining order,..to call the police....that he has no further suggestions,.He didn't answer if someone said they would burn down say a city building would that person not be arrested.

How long would it take to fix the floor? Can you pay an off-duty police officer, or a similarly skilled person, to be present while the floor is being repaired? We have a neighbor & friend in his 50's who is career Special Forces. If you know someone like that, maybe they can be present while the work is performed?

When did this happen? More than a day or so? What do you want to happen?
The DA deals with laws and evidence to prove violations. He is also probably very busy and doesn't waste resources on anything but serious matters.
To you this is serious, but to the DA its not likely to be an actual threat. If more than 2 days have passed, its not likely to be considered an actual threat. Besides, what evidence is there? There is the woman who says that the man made the threat, not against her but against the property, but she reported to you and not to the authorities. What are you expecting? And that has to do with what to expect from the DA.
Fix the doggone floor, and make year peace with the threatener, either get rid of him or else settle. If you felt that there was a real danger, you would have taken action immediately.
The DA won't take you seriously, because YOU didnt take the threat seriously. Its now old history, and the history is that it wasn't serious.

I have called 14 handymen/contractors,..pretty much all that are within 60 miles of this rural area,,..only 5 have called back 3 went out there and said they do not feel comfortable working in that unit with those people,..but they would work with any of our other tenants in that building,..the other 2 said they might get to it in September.
Again, this guy torched his own car,,the ins co denied his claim because of the evidence that he did,..he gets drunk on a regular basis and gets (extra) crazy then, I don't think its a matter of days that is is less crazy.

Testimony of a threat is given more credibility when it is given immediately.
What is the problem here is that you are dealing with an agency who deals routinely with frivolous and insincere problems. The likelihood that this guy really intends to burn down the place is small, he just wants his floor fixed and he thinks a threat will help to get it. The Police know that.
Considering the story I told, the following facts are in order:
The ex-tenant told ME that he will burn down the place.
I called LAPD IMMEDIATELY not a few days afterward.
I spoke to the watch commander, not some rookie at the desk.
I managed to make myself credible by logic, acknowledging that maybe he didn't mean it (the threat), but I was concerned and that I did not want to see the threat realized.
Other facts are extant:
I live in a somewhat opulent part of town. Its not Beverly Hills or Brentwood, but the local Police Division is known as "the country club" because of minimum of crime. The local Division is NOT OVERWORKED compared to other divisions. In addition to having less workload, the division is also more attentive to local concerns than many other divisions.
I also pursued the matter with telephone calls daily asking for updates.
What all this means is that there is a right way to bring a matter like this to authorities.
Again, I ask "what did you want to happen?" and suggest that you give some thought to how to make that happen.

The important point to be made is that one MUST work CAREFULLY to present a complaint to Police. Where one person fails to get action, another might succeed. It takes thought and careful action.
Most PDs are overworked with more caseload than they want. They therefore discourage all but the most serious complaints. However, they are also bound by law to receive complaints from the public, to investigate them, and to present them to the prosecutor for decision about charges. Each step has its own personality. Thinking that all one has to do is to show up at the desk and tell the desk officer that some incident occurred is often not going to produce any action, especially if your case is not really important. You really need to give a lot of thought as to how to present a complaint and how to follow it through.

the tenant that heard it first hand needs to make it the topic of a restraining order or a complaint to the PD.
the matter of repairs is an easy fix...find someone, post the notice of entry and go do it. be SURE to have a thick neck big guy there as a "helper". if the guy gets chesty or issues threats simply roll up the tools and go seek an RO and issue a termination for breach. this is a can of worms but arises probably due to lax screening. a lawyer is needed here --75.80.xx.xx |

In the past, I have gone long periods of time not reading or posting on this board. However when I have participated on this board, I remember getting on your case occasionally. Nevertheless, I still do find value in reading your posts, partly because of your content but also because of your desire to present what you believe to be a very rational argument (whether correct or not).
In this thread, I admire all that you have said and the way you have said it. I consider your posts in this thread to have been very valuable. In this thread, I could not have offered even ten percent of the value you have provided.
