hello.

I have a tenant that keeps smoking in the basement of their apartment. I have reminded them kindly every time I’m over there that it is a non smoking agreement. At this point I feel it’s disrespectful to me on a personal level. Should I take it personally? They are month to month. It’s a duplex so the other side can smell smoke some times. What should you do? Has anyone ever bought and installed the smoke detectors like hotels have that pick up cigarette smoke.

I try not to take anything my tenants do or don't do personally - keep it on a business level. If your lease agreement has a no smoking policy and they keep breaking it and their smoking is a nuisance to your other tenants, sounds like a repeated breach of agreement. Grounds for eviction or serve them a notice of non-renewal of lease and get them out of there. Treatment of smoke damage or lingering odors should be taken out of their security deposit. --47.208.xx.xx

I agree with RT(CA). Keep it business, but it is time for them to go. We always ask if prospective tenant smokes, but only consider those who definitely state no. Do not believe people who say they only smoke outside or are quitting. --184.59.xxx.xx

I deal with this with pot smokers . Just because it is legal here now they think the no smoking no longer applies. WRONG. I ordered giant no smoking stickers online. I stick them on every entranceway to their apartment. They aren’t the kind that are easy to take off. You need Goo Gone and about two hours to get off just one sticker. That usually doesn’t stop them, but it does slow them down. About a week later they get my “estimate “for the smoke remediation. It is $5.60 per square foot . That’s when they stop smoking inside. Right after they call to tell me they have taken care of it themselves. I know they haven’t “ taken care” of anything, but they will smoke outside after that. --68.191.xx.xx

I agree with RT and Doris - Rehab after a smoker, only a so called occasional smoker, is expensive.

Polite reminders don't work. It is unlikely the tenant will stop smoking. And as you noted it probably bothers the other tenants.

To determine the extent of the problem you could conduct a smoking inspection in other areas of the house - take a non smoker with you to confirm the smoking odors. If the inspection reveals the tenant is smoking in other parts of the house your decision should be clear.

Maybe a fan in a window or safer place would draw the smoke out. Might be a $25 problem and you won't have to argue with the tenant. Cellar window might work. A building nearby has glass block with a tiny window in the middle that opens. A little fan in there would be good. Put a chair by the window too. --108.24.xx.xx

Wallet training will be used in the accounting statement, my finding is a 2xrent value deposit might cover the seal/prime/refinishing involved with smoking, hopefully there is little to no other damage or you will have to juggle thru court to get a garnishment on this person. Agree 100% with RT and Doris. Don't take it personally just non-renew the lease - get them out. It is very expensive to get rid of smoke smell IME. I never believe anyone that says they only smoke outside - it's total BS. Had a tenant that (surprisingly!) lied and they smoked in the garage. Couldn't get rid of the smell even after cleaning with TSP and painting.

Renting an ozone generator is a great way to rid a house or apartment of smoking odors. I used one on my parents' house after my dad died - he was a pipe smoker for 27 years in that house and the ozone machine running for about 24 hours did the trick. --47.208.xx.xx

I have been waiting for a doctor to prescribe tobacco and nicotine for some applicants but has not happened yet, for HUD housing providers the breath-easy program went into law in Obama first term. I made a lot of application fees in those years from waiting on doctor letters. --76.188.xxx.xxx
