On allowing animals in your rentals.

Who knows this: If I put on my rental criteria and in

my application that the only way an animal will be allowed is if

1. My insurance company expressly approves that specific animal, and

2. Tenant must carry renters insurance that also covers their animal for $300,000.00 of liability, and

3. The animal application fee is $x

4. The monthly animal fee is $x

Let me know what you think.

Chop it up , whatever, let me know what you really think.

For #1, you cannot exclude an ESA or service animal even if your insurance won't cover it. #2 is a better option, in that you can require tenant to have their own insurance, and that their insurance explicitly list any animal, including ESAs and service animals. If they have trouble getting insurance for their animal, that's on them and you can refuse to rent to anyone without insurance. --71.233.xxx.xx

The only way to avoid discrimination is to treat everyone the same. I require EVERYONE to have the insurance. If they can’t get it because of an animal, they are denied because they don’t have the insurance- nothing is ever said about the animal/pet that they will surely claim is an ESA. Require that they carry the insurance in your lease. Most importantly, do MTM so you can control who and what is living in your investment. --68.191.xx.xx

NJ Senate is voting on an animal control bill after two pit bulls killed a 3 year old and mauled the mother who had her body over the child. Then another child fell out a window into a yard and was killed or mauled further by two of them. Bill says "large dogs" and not a specific breed. It has requirements for fencing and types of leashes etc. and people are going crazy about it. I wonder what this will mean to LLs who already house people with large dogs. Fences are required and some places just can't put up fences. It could help the LLs with people trying to bring in large dogs. --108.24.xx.xx

I've never gotten a renter's policy so I don't know what questions they specifically ask. I see on here quite often where advice is given to be sure a specific animal is included. When I've read through tenant's policies, I've never seen a specific paragraph addressing a specific animal. Seems to me it falls under the general liability. --72.70.xxx.xxx

its called DOMESTIC ANIMAL LIABILITY COVERAGE.

insurance brokers know exactly what it is

if offered by carriers, the policy MUST CONTAIN language listing ALL EXCLUDED BREEDS / MIXES / POUNDAGE AND your specific policy MUST ENDORSE IN WRITING the specific animals in your property. be they pets, esa's service animals, astrological advisors or domestic partners.

MANY BROKERS and CARRIERS will simply say NO, to avoid having to committ to anything in writing.

Sustain a loss, submit a claim without proper policy language in place,....you're stuck.

Most problem breed tenants (their animals,....not them) know the ropes WAY BETTER than you or your insurance agent,....and those four words, as at the top of this post,....will generally send them on their way. --172.250.xx.xxx

I was able to exclude a large mean aggressive ESA animal from my applicant who was trying to rent a vacant apartment. The process wasn't easy. The applicant had several agencies tell me that I can NOT exclude any ESA or Service Animal. I told them they were dead wrong and I'm willing to fight them in court. I told one guy from a Free Legal Defense Fund for Tenants that I couldn't help it if he, the attorney, was "Blind, Deaf or Dumb"!

A landlord's insurance carrier (Fire and Liability) will cancel the policy if a tenant has a violent dog on premises. Once a landlord loses their insurance then their lender will call in the loan. This will put the landlord out of business and therefore under many laws it is reasonable for the landlord to exclude someone who will cause them to hinder or loose their business/property.

Second, a dog that attacks other tenants and neighbors is defective. If the dog goes through obedience training, it may become sweet and easy to get along with. So you can tell the owner of the ESA BEAST to:

1) Take the dog to obedience class and curb it's propensity to attack others.

2) Replace the dog with another dog who's not so mean and its a breed that loves and not hates!

3) Give the dog away and get a more manageable pet. The shelter has hundreds.

As the landlord, contractor and handyman of my properties, when I meet the dog who's going to be living in an apartment, if I can't get along with it, then I won't accept it anymore.

Also I take a picture of the tenant with their dog. They sing a form that if they want to replace or take in a second animal, they have to get written permission. Otherwise if the animal becomes a problem, I will evict. --47.155.xx.xxx
