Tenants started to complain a lot of problems and hard to communicate lately. Before I just gave 30 days notice. Due to this new law. The Fair Housing Commission (FHC) is responsible for enforcing the “Good Cause” eviction law. The law amends the City’s Fair Housing Ordinance.

Examples of Good Cause reasons to terminate a lease:

1-Habitual non-payment or habitual late-payment of rent (this does not apply if the tenant is legally withholding rent).

2- Breach or non-compliance with a “material term” of the lease.

3- Nuisance Activity engaged in by the tenant that interferes with others’ use and enjoyment of the property.

4- Tenant causes substantial damage to the property.

5- Tenant does not allow landlord access to the property, after the landlord has provided written notice.

6- Tenant refuses to sign an extension of the lease for generally the same lease terms.

7- Owner, or an immediate family member of the owner, is going to move into the unit.

8- Tenant refuses to agree to a reasonable rent increase or a change in the lease (landlord must provide notice to tenant and opportunity for response).

9- Owner wants to make renovations with an empty unit (must provide notice and options to tenant).

I see your wheels are turning and coming up with some good ideas. But here in California the "Landlord" is the "King" of his land. Able to make rules and conditions that he puts into the lease "or" the "House Rules". But once the lease is signed and executed, the Landlords "Status" changes.

From "King of his castle ruler over the lands" the landlord turns into the "Jester" and is laughed at and abused by all parties -- his tenants and City/County officials. The Judges often saying, "and you wanted what? Not enforceable". Why? Because to "evict" a rental has to pass all codes. So if a tenant refuses to take out the trash, leaves a window open with the screen removed--then in 24 hours there will be unwanted guests, vermin and insects. So now from being a landlord able to enforce an eviction, we become a certified slumlord.

So now when a tenant is "doing something wrong", I've had to learn how to communicate with them like I had to learn to deal with my teenagers. After a couple or verbal and text messages, I'll issue either a stern warning OR issue them a "Notice to Perform or Quit", LISTING the violations -- time and place of occurrences and any witnesses.

So instead of saying, "Judge the didn't do what the lease says", I explain that refused to listen to reason and obey common sense, city health and housing codes AND put others at risk. Then when the tenant kept of doing this over and over again, then finally I gave them the official "5 day notice to perform or quit". And they did it again and again.

So the judge can see these tenants just didn't do what I "Liked" or made a 1 time mistake. The tenants are up to no good and causing a nuisance, damages, etc.

Like my teens, we ask them to clean up their room, this is there responsibility under our House Rules. We ask. We give the notes. Then the sit down conversation. Clean up or move out, oh and for good measure we want your cell phone back while your thinking this over....They refused to hand over their phone as we key in a code to suspend their minutes... --47.155.xx.xxx

MC, It's a City of Philadelphia thing.

"The Fair Housing Commission enforces the Philadelphia Fair Housing Ordinance, Chapter 9-800 of the Philadelphia Code. The law prohibits certain unfair rental practices by landlords against tenants. It also gives the Commission the authority to address unsafe and unhealthy conditions in rental property."

"The Fair Housing Commission is comprised of five members appointed by the Mayor. Commissioners decide disputed complaints through adjudicatory hearings. Commissioners also can conduct investigations to address unfair rental practices in properties..." --73.40.xxx.xx

That would be 5. They are giving complaints and refusing to communicate to give you an appointment to repair whatever it is they are complaining about. I guess you are going to have to start posting written notices trying to get in to do repairs.

It might be 2 if your lease is clear about how communication has to happen and if that isn't in your lease, I suggest that you put it in now because the law isn't going to get any better in the future.

It sounds like you can give them a smallish rent increase to pay for your inconvenience. Maybe they will refuse to sign that, which would then be grounds to evict.

Its not just a Philadelphia thing.

Many jurisdictions have enacted a "just cause eviction" statute. Landlord cannot evict except for a just cause. Many such statutes specify reasons, like failure to pay rent, failure to perform according to the lease (some statutes require MATERIAL lease violation), etc. It started in San Francisco, but is becoming popular, along with control of rent increases.

I wondered with the op was talking about until Philadelphia was mentioned. The rest of Pennsylvania doesn't follow that. Philadelphia probably should annex itself from the rest of Pennsylvania for all things legal since so much of what happens there differs from the rest of the state. --72.70.xxx.xxx

Just jack the rent way up to where they cannot afford it. Philly does not have rent control, yet. The Leftist housing activists. Admit that the good cause eviction is the first step, but does not do much without rent control. Paulo, you are right, philly politically would fit in better with nj, esp. With gun laws. I thank god that we have the rest of penna. to restrain our leftist philly politicians. The so called progressives are adding one burden after another upon landlords, one procedural tripwire after another to deny landlords rent and access to the courts. They actually claim that they need to do this because it is so hard to find rental housing, as if driving landlords out of the business is gonna create more rental housing. This is complete stupidity here where the extreme left wing tenancy advocates do not even represent 0.01 per cent of the population. As bad as is there is consistent Landlord & Tenant act in the province of Ontario where building and fire code rules vary by municipality. Many times have attended political discussions where those in union movements did not like what I had to say about rent control. In 1975 when rent control was brought in the province of Ontario there were wage and price controls where limits were set on how much unions could be allowed to increase. There needs to be consensus on this as you can not have increases in one sector without effecting other sectors. The government owned rental units have excepted themselves as they feel rent control is poison. What happens the most delicate sector of rental housing is the secondary rental housing market which are houses, townhouses and condominiums which are sold off to become owner occupied where rental units are lost forever. The extreme left wing nutcases do not understand economic reality where there is enough money in the provincial treasury to completely buy out the private sector rental housing. How do you have universal medical care which is somewhat socialist while becoming the sole supplier of rental housing. If tenants want the ultimate nightmare see some videos on TCHC rental housing on You Tube.
