I advertise “no pets” but I get “ it’s not a pet, it’s a ESA” !

Tell them nothing regarding the animal. If your screening techniques are good, other issues will be uncovered. Reject for those. Also plan an at home visit at their current place. Find out if they allow that ESA animal to trash their place. Does it smell, do they keep it clean. Realize what you're looking at is your rental if you accept them. --108.69.xxx.xxx |

Think of them as like a hospital bed,they are not a pet.Dont reject for the pet,find another reason,most who need a dog with the excuse that they need it for emotional support will have other reasons to reject.You cannot charge extra for them either --72.231.xxx.xxx |

Each State, City and jurisdiction has it's own rules when it comes to ESA animals. Here in my neck of the woods all Dog has to be "licensed" annually by the city. A landlord can request proof of the animal being "vaccinated". Also I can meet the "animal/dog" before approving the applicant.
When meeting the "animal", if it's not behaved, trained or acts with aggression, I can deny that Animal, ESA or not! But, I have to be prepared to fight back with my attorney because the renter will make up stories.
I had an upstairs apartment for rent. The applicant had a 60 pound ESA dog that when it walked on the laminate flooring, it made too much noise for the downstairs tenants. Also the dog was hipper and couldn't sit still. The applicant worked all day so the dog was going to be left alone. I rented the apartment to another applicant with a small ESA dog, that only smiled and wagged its tail. When it walked, there was silence. The person with the large dog filled a complaint, I refused an ESA dog. I had to put up with the City Worker who wouldn't listen, so I had to attend a meeting and give them a piece of my mind. --47.155.xx.xxx |

They do smile don't they, Robert J. There was one at the vet and the owner said to me it would not listen or respond to her. It was a Puerto Rican flood rescue dog. It was brown and had long legs but small maybe 20 lbs. So I realized it spoke Spanish and I said Bueno Perro to it. This little brown thing turned to me, bowed and had the biggest open mouth full of teeth smiling at me. Our little cousins. --108.24.xx.xx |

A person's home is usually (unless there is abuse) the most controlled, calm environment for all people. And yet, they need an animal or they cannot "enjoy the property equally?" That's what the law is based on; the doctrine of accommodation to provide equal opportunity for enjoyment of X.
There's your sign. You say nothing about the animal/pet. Look for the rest of the disasters in their life by their absolute inability to exist without an animal at their side 24/7. You will find job hopping, frequent problems with past land lord, criminal activity, unpaid bills, etc. Reject for those reasons.
If the ESA is legit, you will find nothing. The tenant will have excellent references. Nothing to worry about as long as they clean up after the animal and it doesn't do any damage to the property. That isn't allowed even if the ESA is legit. But, odds are you will have many who try to scam the system. Scamming the system doesn't just show up as an isolated issue one time. Scammers do what scammers do. Most likely they will have multiple other problems like the ones mention above which are 100% legit for denial. It is almost impossible to compartmentalize bad behavior to one thing (i.e. faking an ESA). Most likely those folks have been faking their way thru life for years, and the disaster trail behind them will show up with minimal scrutiny. Pull credit, pull background check. You'll fine the scammers easily.

service animals,....by whatever name if legit are well trained, disiplined obedient and under their owner/ handlers complete control at all times. and I very specifically use the term handler.
I've seen dogs sitting in supermarket baskets where the next customer might place their child. I've seen them relieveing themselves in supermarket aisles. I've seen them in fancy restaurants sitting on the booth cushions being hand fed by their owners.
Several years ago, I was at a well known winery in ca wine country, having a pricey lunch in the winery's tasting room / restaurant. At the next table was a clearly ''fancy lady'' with her rat dog on her lap,....front paws on the crisp linnen table cloth,...feeding it from her plate.
I brought it to the matre-d's attention,....he shrugged (like I was being out of line) and asked if I would like to change tables.
there ya go,......and to be clear,....I am an animal lover.
of curious note,....one of the first rules for any kind of ''working animal'' --- is,.....four on the floor at all times.
this is all getting very much out of control.
