This is just a what if.......

A tenant gave notice that they are moving. Advertise the property and find new tenants before old tenants move out.

New tenant pays a holding deposit and signs holding agreement. Lease will be signed on day after old tenant is scheduled to leave.

What happens if the old tenant does not leave? You could evict as a holdover but that takes weeks or more. The new tenant has already paid the deposit and is expecting to move.

What would you do for the new tenant - return the deposit and say so sorry...... What else could you do? Any liability from this?

I had tenant sign a holding agreement today - I'm not expecting any trouble from the vacating tenant but am just wondering what if..........

That’s why I don’t try to do close turn overs. I re-rent when I see the moving van being loaded. I will hold maximum two weeks not a month so the tenant will pay double rent for two weeks: --99.23.xxx.x

Constant communication with outgoing tenant is key. If you have ANY doubt she's not leaving (why are you worried about this? Is there some sign?) then I wouldn't promise the place to the new person. --12.25.xxx.xxx

I have a clause in my Rental Agreement that says, basically: if something happens that is not under my control (fire, tenant holdover, tree smash through roof - whatever) the parties to the Agreement may negotiate ( mutual consent) to either delay possession temporarily or break the agreement, depending on how long the property is uninhabitable for new tenant. --75.150.xx.xx

It depends upon what state you are in. You might be required to pay to put the new tenant in a motel until the unit is vacated and repaired.

I've had tenants not be out on time more than once. There is a high over-stay rent and that keeps most of them on schedule, except that if they are down to the wire, they don't do any cleaning because they run out of time.

It's a tenant thing where they think that they can pack and move in 24 hours, which is just about impossible. But some of them won't do anything to prepare to move until they are up against the deadline. I simply don't trust that they will be out on time. --76.178.xxx.xxx
