When issuing a letter of non-renewal of a rental lease and there is a co-signer on the lease, do I send letter to just the tenants or am I legally obligated to also notify the co-signer?

Considering the small amount of time it would take, i would definitely notify all parties, to be on the safe side.

If, for any reason, you do not, it could postpone everything.

Thanks for the reply - my dilemma is a letter was already sent to the tenants and they're claiming I'm legally required to have notified their co-signer, thus they claim that my non-renewal lease letter is not valid. They don't want to leave.

Trying to avoid an eviction to get noisy tenants out that keep violating the noise/nuisance clause in their lease agreement. --47.208.xx.xx

"Do you have to give 30 day notice if lease is up California?

You DO NOT have to give a 30-day notice at the end of a fixed term lease. "A lease expires automatically at the end of the lease term."

They are trying to scare you. Don't be intimidated.

Like Jerry said, a co-signer is about being paid what is owed, not possession.

However, in my opinion, I would also notify the cosigner in case they have influence over the tenant to act better - since they won't want to pay for court costs, hold-over rent & damages after the tenants are evicted. --68.229.xxx.xxx

Jim - my understanding is that non-renewal of lease is not an eviction and that I don't need cause, even though I have documentation of two 911 calls and a documented noise/disturbance call to the sheriff's department. Also, numerous emails and text messages from adjoining tenant about the constant noise these people make. --47.208.xx.xx
