Hi all,

It has been a while. I have a prospective applicant looking to rent a place. I want to reject, but want to know if my reasons are considered valid.

1. Do we have to count child support payment as income? She's collecting child support payment for her grandkids. I have never heard of that and wondered if that's a thing. What kind of document could we use as proof such thing?

2. She has a car payment that would make her under the income at least 3x rent threshold. Could we deduct car payment from income when calculating income requirement?

I'm not feeling good about it and want to reject. But I want to reject it properly. She's claiming she's working 2 full time job + child support. Even that, she's barely making the income threshold. If I deduct the car payment, it will be below the income threshold. --212.102.xx.xx

It partly depends on how you apply your written criteria to other prospects. Do you usually take 3x rent gross or deduct car payments? Do you require 3x rent amount that can be garnished? Are you changing your criteria right now to apply the same way moving forward? --75.67.xxx.xxx

When I reject for income, I tell them “unfortunately the owner of this property requires a minimum monthly income of $xxxx to qualify, however we wish you the best of luck with your search” --73.177.xxx.xx

It is my understanding all forms of income must be counted. I get a verification of all income such as pay stubs, child support and alimony. I look for 2.5 times the rent net after all scheduled payments such as a car payment or loans. When I reject I simply state the property went to someone more qualified. If they were the most qualified of all the applicants they would have got the property.

The last time I had a complaint, I said simply said the person who got the property had a $300 car payment and the person who did not get the property had a $700 car payment, you do the math. New car vs used car. --99.23.xxx.x

I will ask for pay stubs for the two jobs as well as the child support payment and then decide.

She said she has an emotional support pet. When I look online, I can't even charge my normal extra pet deposit for that. But I could require an ESA letter from a licensed healthcare professional. --212.102.xx.xx

Find a way. The emotional support pet is the last straw. Do not count child support for grand children. It is not guaranteed and people have to go to court to get it. Very iffy. So then she does not make enough but do get the pay stubs and make sure they are not fake somehow and reject. She can't possibly be working and have custody of the grand kids often enough to get child support. --108.24.xx.xx

Is the child support from the state (as in paid for kinship foster) or from the parents? If it is foster child assistance, then we count it. If actual child support, I want to see that it is received consistantly. Too often it isn't.

I look at the whole picture.

If rent is $1000 and car payment is $500, then I look a the rest.

For a family of 4 with the above, I'd expect to see $200/month in utilities for the home, then other car expenses (insurance, gas, repairs) and I'd assume about $300 a month for that, then food. For a fmily of 4, I'd plan on $200/week or more. Internet, maybe $50 - $100.

So, they have a minimum monthly expense of $3000 a month for just the four walls, car and food. I'd want to probably see income of at least $4500 a month in the above situation to cover all the rest of the stuff that comes up. --67.43.xxx.xxx

Check TX law to find out what you "have" to accept. If you haven't read it for a while, follow the link in the upper left of this page. Read, print, study and apply it all.

Going forward, please do yourself a favor and have written qualification criteria before advertising a unit for rent.

Also have a written plan for how you will evaluate applicants.

Don't reject - but don't approve. Take your time processing the application. In today's market you should have no problem finding and approving somebody you like while you are processing this one.

I still remember when, years b4 I became a LL, my gf (now wife) went to apply for our first apt together and the first thing the mgr said to us when we said we wanted to apply was “if you don’t make $35k you can’t apply”. which at that time I did not. my response is not acceptable on this site. so then we found a duplex off the M streets in Dallas and the LL gave me $25 rent credit for mowing the yard 2x a month.... --107.77.xxx.xxx
