Tenant owes 3 month rent. Has not responded to several phone calls and e-mails. It is not clear if she has moved out. I am in the process of filing an unlawful detainer. Can I change the locks without court order for eviction? Property is Richmond, Virginis based. --67.166.xxx.xx

Locking a Tenant out of the residence (whether rent is baing paid or not) is called "Constructive Eviction". In other words, you are denying the Tenant access to the rental. Wait until you get notice from the Tenant or a court order from that eviction before doing anything Unless you can clearly SEE that the house is empty and the keys are on the counter or you get a notice from the Tenants. Tenant may just be hiding from you or worse, is terribly ill or died. --72.220.xxx.xxx

It’s really only a self-help eviction if you change the locks and refuse to let the tenant back in if they appear. I have had unclear circumstances like this and I’ve changed the locks. But I posted a notice on the door to contact me at my phone number in order to gain immediate entrance. No one ever did. --50.107.xxx.xxx

Have you thought about physically checking to see if the tenant has moved it?

Drive by and see if cars are in the driveway (if a house). Drive by at night to check for lights.

Or be brave and march up to the door, knock and see if anyone answers.

Read up on abandonment. In Va, I believe we can obtain possession after it has been deemed to have been abandoned.

THE PREMISES WILL BE DEEMED ABANDONED ONLY UNDER ALL OF THE FOLLOWING CONDITIONS:

TENANTS FAIL TO RESPOND TO OFFICIAL NOTICES FROM THE LANDLORD, AGENT OR LOCAL GOVERNMENT OFFICES DELIVERED BY THE US POSTAL SERVICE WITHIN SEVEN DAYS OF DELIVERY.

TENANTS ARE AT LEAST (7) SEVEN DAYS PAST DUE ON THE RENT PAYMENT FOR THE CURRENT MONTH

LANDLORD / AGENT HAS MADE A PHYSICAL INSPECTION OF THE PREMISES TO VERIFY OCCUPANCY BY TENANTS OR THE LACK THEREOF.

LANDLORD / AGENT HAS NOTIFIED THE TENANTS IN WRITING THAT THE PREMISES WILL BE DEEMED ABANDONED WITHIN 7 DAYS UNLESS TENANTS RESPOND TO INFORM LANDLORD / AGENT THAT THE PREMISES HAVE NOT BEEN ABANDONED.

IN THE EVENT THE PREMISES ARE DEEMED ABANDONED UPON FAILURE ON TENANT’S PART TO RESPOND, THE PARTIES AGREE THAT THE LANDLORD / AGENT MAY SEIZE POSSESSION OF THE PREMISES INCLUDING THE CONTENTS OF THE PREMISES. I am not sure about Virginia laws, but in Michigan we post a written notice on the door. It can say " 24 hour notice to enter these premises, by the Landlord who owns this property. Taped to this door on June 6, 2021 at 11:10 a.m. (example)

Delivered by: Your name and date.

Tape it to the door, take a photo of the notice along with the house number, for verification. Wait the 24 hours and viola...you have the right to enter.

Before entering knock several times. Go around back and knock, do whatever to make sure no one is actually home. Even after I enter I speak loudly and ask, " Anyone home??".

If all is clear do your inspection. Determine if the house is still lived in. I always go to the refrigerator first. It can hold good information. Again take photos or better yet a video, even as you knock. It is what I have done.

If indeed it is empty, change the locks. If it is furnished you will need to go to court. --67.22.x.xxx

I can do it in TX, but I have to follow very specific rules and timelines. I need to give a certain number of days' worth of notice; I need to post certain information on the door so they can get in touch with me 24 hours a day and I can give them access to their stuff; and so on.

It's my understanding that Virginia is far less friendly to that path. --137.118.xx.xxx

Set your calendar back when rent was late and begin yelling at the manager that allowed this to occur, fire them if not handled within a week - proper court paperwork should have stated awhile ago and you would be showing the unit to applicants and possibly back on the happy tenants list by now. --76.188.xxx.xxx
