State Specific Question About: PENNSYLVANIA (PA)

Curious to hear how you handle security deposits if no forwarding address is given to you. I’m in PA thank you. --71.112.xxx.xxx

Send it to last known address which is your rental,if it comes back leave the envelope unopened in case they sue you,if they do give it to the judge to open and show him the date on the envelope when it was mailed to prove you mailed it within state guidelines --72.231.xxx.xxx

What Ken said. In addition, I mail it Certified so I have proof of date/time mailed. It's not up to me that they receive it; it's up to me that I properly mail it. My obligation ends once the envelope leaves my hands. Most get returned to us and I keep them in the tenant's file folder along with their move-in/move-out inspection report. --107.216.xxx.xxx

Technically you don't have to do anything. Practically and for the small amount of time involved, do it anyway and also take the extra step to prove you did it. No reason other than it's easier to prove later and make whatever accusations might arise disappear quickly.

If I owe them money, they pi$$ed me off and made my life difficult, I send it certified mail, restricted delivery. Just because. If there were no issues or no deposit funds to be returned, I send regular mail with the proof of mailing from the post office.

Tenants love to sue their former rich landlords. So what I do is the following. I scan/copy the deposit refund letter, the payment check and the envelope containing it. I sent it to the last known address, my rental, with a tracking number. I also keep my receipt. Then if the tenant didn't put a forwarding address or change of address, I'll retrieve the envelop and save it for court... --47.155.xx.xxx

Ron,

My old judge commented that if they cared they would submit a mail forwarding card to the PO. Many don’t because they are running from creditors.

We send it to the last known address using a website called ShippingEasy.com

$3.46, proof I mailed it on time, tracking, and it’s picked up at MY mailbox by the carrier - no trip to the post office.

Check your state law. Some require CERTIFIED.

PS

When I decided to get businesslike and charge people for what they left me to clean up there was very little deposit money, if any, to return.

Depends on state law, as with everything. NC law specifically states that if Tenant does not provide forwarding address, LL is to hold the deposit for six months. If no contact by then, it's theirs to keep. --50.82.xxx.xxx

HOWEVER, I should state that if you are withholding anything from the deposit, you do need to provide a written interim accounting within 30 days, with a final account within 60 days maximum. It doesn't state where you send that though. --50.82.xxx.xxx

Thank you for the response. So I did send the deposit with letter and check to last known address and it came back to the address he rented from me. Now he is asking how to receive his deposit...I explained his obligation to leave a forwarding address and he states I must have missed that in my lease and now sends me his forwarding address 21 days past the 30 day deadline. What would you do. Thank you again. --71.112.xxx.xxx

Send it to him certified, restricted delivery and move on with your life. Yes, it will cost you $7ish (not sure) dollars but move on is the important part. --72.70.xxx.xxx
