As a new landlord (we just closed yesterday) are we able to get new rental agreements signed by the tenants?

These are questions you should've asked before closing.

You can ASK the tenants to sign new rental agreements, but they don't have to comply. You are bound by the existing agreements. Whenever they end you can then start your agreements.

Going to the property and standing in the driveway is probably ok. Going into the backyard or creeping around the sides of the building without notice is asking for trouble. --12.44.xxx.xxx

You and the existing tenants are all bound by the existing leases. You can terminate all existing tenancies when the existing leases expire and replace the current leases with your own leases. Be sure to give proper notice of the termination/new lease.

If you are talking about single family residences, you probably cannot venture onto the property without proper notice. If it is an apartment building, there are likely to be common areas which you are probably allowed to be on without notice to the tenants.

Don’t use your full name on this site. Each time we purchased, I went and knocked on doors of the multi family and introduced myself and gave them contact information and asked to set up a time to see the inside and do a condition report. At one building it was a sleazy landlord that had used security deposits as last months rent and didn’t collect rents for the month we closed. He was ready to walk from the closing and we opted to move forward so I rent collected. The second building had a tired landlord so there wasn’t a single fully executed lease with all signatures or any lease on some units so we deemed them null and void and I gave them a new lease and intent to vacate paperwork telling them I would be back in touch the next week. --75.67.xxx.xxx

The law is called TENANTS’RIGHTS. But everything is negotiable.

When I inherit residents we sign MY lease because it’s better and we’re gonna play by MY rules.

Understand many investors sell because they are sloppy managers.

BTW you need an ESTOPPLE LETTER signed by each res which documents their deposit, appliances, parking spaces, special terms, etc.

You are new so here is the first thing you MUST learn - renters LIE!

The seller will say there is no depsoit but the res will SUDDENLY appear with a handwritten receipt for a million dollar deposit and state the new stainless appliance are theirs.

Verify everything.

You are new to being a landlord? Treat your tenants with polite manners. It goes a long way. Give them their 24 hour notice that you will be coming around.

If this is a multi-unit that does not have individually fenced yards, you can wander around the grounds as often as you want without notice, as long as you don't go into any area that is under the tenant's control or peer into windows.

If it is a free standing house or duplex, give the tenants notice. While you can go into the front yard (if it isn't fenced), why would you intentionally irritate the tenant? You are running a business, you should be capable of planning 24 hours in advance so that you can give the tenant a heads up that you, or your gardener, or your plumber, or whatever is going to be in the yard the next day. --76.178.xxx.xxx

If it is a reoccurring entry, you can give a blanket notice, such as "Tuesday is the scheduled day for lawn mowing and the gardeners will be on site every Tuesday for yard maintenance".

The existing lease goes with the property. However, you can request that the tenants sign your rental agreement. They don't have to, but if your lease is fair, they might sign without objection. Don't expect any tenant to sign for higher rent before their current agreement expires.

I would ask tenants to fill out my rental application. They are already approved and in the unit, but I would like to have their contact information. You can't make them do it, but if you ask nicely, some of them will do it.

If the tenants are on month to month agreements, you can have them sign your rental agreement by giving them a 60 day notice that their old agreement is being terminated in 60 days and a new one will be signed.

Keep in mind that Oregon has a legal limit to how much and how often you can raise the rent. --76.178.xxx.xxx
