I am an owner of a multi-family house in Northern NJ. One of my tenants is asking to be let out of their lease early. I am in Complete Agreement as they have been nothing but trouble so I am taking this opportunity to let them out early.

I am writing them a letter and it will include per our conversation we are in agreement of the early release but not sure what other important information should be written in the letter and should I give them a time frame?

Definitely include an end date! Discuss it with them, get agreement then it all goes in writing.

"Per your request, we are agreeing to end your lease without penalty on Month Day Year. You agree to have the house clean and ready to occupy and to vacate the premises by noon on that date and to return all keys. Be sure to provide us with a forwarding address so that we can return your Security Deposit according to state law." (Which means if the place is undamaged, all rent paid etc.)

Agreement to Cancel Lease

This agreement is entered into on the following date: ___________________, between _______________________________________ (tenant), and _____________________ ____________________________________ (landlord).

Resident has asked for Permission to break or cancel the lease agreement between the parties on short notice and/or prior to the expiration date of the agreement. Resident wishes to move out by the following date, ______________________ even though he/she will not be able to give proper notice as required in the rental agreement. In exchange for landlord agreeing to cancel the agreement, tenant agrees to the following terms:

1) To pay a non-refundable cancellation fee of ________________ on or before _______________.

2) To promptly return keys to Landlord and completely move and vacate the premises on or before __________________, which shall be considered the cancellation date of lease.

3) Provide a forwarding address to landlord prior to vacating the residence.

4) Leave the residence in a clean condition and free of any and all damage.

5) Allow the Landlord to show the premises to any prospective resident with as little as one hour notice, anytime between 9:00AM and 7:30PM. If tenant can not be reached with good-faith effort to do so, the Landlord may enter and show the residence.

6) To hereby forever release any claims or causes of action that tenant may have or that shall arise in the future against landlord or agents arising out of the lease agreement.

If the tenant fulfills the obligations agreed to above, landlord agrees to:

1) Release resident from any further obligation to pay rent.

2) Provide positive report regarding completion of lease term to credit or tenant reporting agencies.

3) Return the ______________ security deposit, provided that tenant has complied with the above terms, and provided that there are no unpaid outstanding charges of any kind due from tenant and that there are no damages to the property.

In the event tenant does not fulfill the terms above or is in default under any of the terms of the rental agreement, Landlord shall have the right to keep and apply the aforesaid cancellation fee towards any damages arising as a result of such default.

I did not read about another person staying on in this unit of the multi-fam unit so you would follow your state and local rules about the deposit accounting statement, if there is someone else staying behind then do nothing to limit your ability to collect on damages owed after the unit is empty of all food, packages and furniture. --76.188.xxx.xxx

She has 30 days to return security or an accounting of any damages with held. She has to send along a bill or estimate for any work done to remedy damage if she deducts for the damage. Here in this lovely swamp, once a tenant has put a date in writing, they have to be out or she is entitled to double the rent if they do not vacate. --108.24.xx.xx
