Hello everyone,
This is a question for Arizona Landlords. Mainly in the Phoenix area. My questions is what is your procedure for eviction? How long does it take? It a tenant objects to the eviction does it go before a civil court?
My friend has a tenant who was not on the original lease but wants to stay in the apartment and pay the rent. This tenant is in Chapter 7 bankruptcy right now. So far this tenant has paid the last 2 months of rent which is 1200 per month. This tenant could not qualify on an application. In this situation it is not because of nonpayment of rent

Not an answer to your question but I had some people come in like that after a relative left. They paid their rent and are still there and made me a ton of money since 1998 with no vacancy in the building. Had a bankruptcy but paid me. They would not have qualified either. --108.24.xx.xx |

I'm not sure if covid regs have changed things, but a few years ago, you post a 5 day to pay or 10 to cure. You next file for unlawful detainer on the 6th day and serve them. We used to get a court date about a week later. After court they get 7 days to lockout. If you hit the days perfectly it can be as short as 21 days, but 30+ is more realistic.
I actually wrote one of the first commercial Bankruptcy programs back around '96, boy was that a disaster. It turns out bankrupt people don't pay their bills... LOL
If they are in Ch 7 they can "reaffirm" or continue paying for certain items that are removed (so to speak) from the bk. So they could give you the form to sign and just pay as normal. (Often they end up including reaffirmed property in the bk down the line.)
As for adding the new tenant, just do as usual, credit (not much point) and background and write up an addendum to the lease. Or just start a new lease. Assuming you want the person. --47.216.xx.xxx |

This occupant needs to leave. Try to talk him out. If not, file immediately.
This will not go well. Don't be fooled by the recent payments. I predict a loss of several thousand$$$.
BK will delay eviction. Then the BK will wipe out the rent he owes.
