I see in the news that the federal government wants to set aside intellectual property rights for the Covid vaccines developed in the States, so others globally can produce the vaccine to fight the pandemic. More government giving away private property, IMO. I’ll bet all those pharma CEOs working on Covid treatments, vaccines, etc just told their teams to tap the breaks until we see how this plays out.

I see you are back to socializing costs and privatizing profits. If a company received US funds to develop said vaccine it belongs to the US govt and the people. And since the US gov funded the entire initial research any company that didn't take funds to develop should have limited intellectual property rights. --72.49.xxx.xxx

JAC, this is not my personal issue, so I do haven't followed it closely. How much of the development funds came from the US govt? How much of the funding (including accumulated knowledge and techniques) came from private companies?

What strings were there on the development funds that came from the govt? Were these strings disclosed when the govt offered funding? Don't help fund my research and then suddenly assert that because you helped fund it, you own it!

The strings of common sense. Don't accept public funds for your private companies development and operations and expect to own the rights to that product. While it often turns out that way because of poor ideologies in this case it didn't. It depends on how the initial funding was set up. If it was set up as the headlines read to me ......the President at the time purchased millions of doses of untested vaccines. So if they were able to to do R & D based on that, then the company should own the patient. If they received RD funding directly though, the Govt owns it.

Since there were so many different paths followed, I am inclined the government didn't centralize it. This could go either way - it really depends on the initial how IMO --24.154.xx.x

DJT definitely purchased the finished product before it was made in order to make sure it would be made. The companies worked day and night non stop to save lives and had technologies that were already in the pipeline from the last SARS outbreak. Especially for Moderna. --108.24.xx.xx

The CARES Act included 10 billion to be distributed to drug companies to develop vaccines and other things. Pfizer's lawyers were smarter. They did not take the government development money, developing their vaccine on their own dime. Instead, they presold to the U.S. government 100 million doses for $2 billion.

If handing over the intellectual property was part of the original deal, then I'm OK with that. If the rules were unilaterally changed midstream, then I'm not OK with that, and it sounds like that's what happened, although we'll never know what agreements were discussed behind closed doors along the way.

As for socializing costs, this pandemic has always been a socialized cost. It's not as if we're taking a private industry burden and asking the public to bear the cost. I'm not generally a fan of that either (see various industry bailouts during the financial crisis). It's been a socialized burden all along. Just like if a hurricane leveled Florida, would we expect private builders to reconstruct people's homes for free? --100.34.x.xx

Paulio, I don’t ignore the fact that perhaps there was some sort of “understanding” there, and now it’s coming back to bite them. Or perhaps a “if you wait until after the election, we’ll give you six months to make all the money you can and then it’s ours” deal.

Seems intriguing to me when the trial was supposed to end after 32 positives, but with the fall surge, they reached 32 positives a lot faster than expected. Then they bumped it up to 54 positives, and then 96, before they finally decided to end the trial, which coincidentally was announced the first business day after the election was called. Not saying I think that’s what happened and we’ll never know, but I do think it would make for a good movie. --100.34.x.xx

JAC, you are absolutely wrong assuming that using Government money to develop a product leads to the Government owning the intellectual rights. I worked for 30+ years along side the National Labs and I can tell you that everything they developed used Federal money and the Lab owned the intellectual property and patents, the Government maintained, through contract, the right to use the technology but not to own it. Your example of a contractor is absurd, intellectual property ownership has nothing to do with hired to perform or Management and Operations contracts. --64.130.xx.xx

If the Government were able to do the work they wouldn't have contracted with the experts to do it. In this case (as in most of these types of contracts), the Government is looking for a solution that doesn't exist, the business has an ability but not the deep pockets to make it happen. They call it a partnership for a reason, neither has everything necessary, both bring something to the game and both walk away with something. What is disgusting is for the Goliath in the partnership to change the rules after the contract is signed. That goes beyond disgusting, it is flat out immoral and unethical. I know it's hard to swallow for some that the current administration is being unethical, but I have to call it like it is. --64.130.xx.xx
