In case anyone wishes to read it, the case of the Alabama Associaiton or realtors vs HHS on the eviction moratorium. This one was filed in the US District Court in DC. The moratorium was struck down yet again.

A federal judge on Wednesday threw out a national eviction moratorium, saying the Covid-19 pandemic-relief measure exceeded the powers of the Centers for Disease Control and Prevention.

The ruling from U.S. District Court for the District of Columbia Judge Dabney Friedrich negates a program that has helped millions of tenants who have fallen behind on their rent during the pandemic. --108.24.xx.xx

This comes right AFTER the county of San Diego extended our rent moratorium and changed the rules to evict. Just voted on 3 to 2 last night. It now forbids eviction for anything except imminent danger from the tenants. No more evicting for moving in relatives, no more evicting for 'major repairs'. Closed all those loopholes. No evicting period. It will go into force now and extend 60 days past whatever the CDC moratorium says is the final day. Currently our final day is June 30, so figure August 30 and then maybe we can evict for just cause again. I am not optimistic about an end to the moratorium. Thank goodness my 2 little rentals have paid perfectly, on time, no complaints. Funny thing about the eviction moratorium is the loudest proponent, who is always giving her opinion on the nightly news, and in the council chambers, is that she has been evicted THREE times since this whole thing started. Just watching her rant and claim damages to her and her kids is enough to make me turn the TV off. Loudest voice wins? I keep thinking, 3 kids and her that makes 4. Stimulus checks totaled $3000., each person, so they got $12k in the past year. I suspect none of that went towards rent. --72.199.xx.xxx

I sometimes think that if we end up with any kind of "great reset" or whatever, we'll end up with the entire Midwest and two coasts. The folks on the coasts are the ones who think eviction moratoriums, masks forever, cancel rent and shut downs are a good thing. The rest of us are kinda like, "Whatever makes you happy just keep it to yourselves. See you in a few months/years."

It's almost like the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.... and we understand and respect that here in flyover country. --107.216.xxx.xxx

Sid, I would not generalize that about folks on the coast and/or the entire Midwesterners. I can assure you my local landlord group(s) do not think any of those options are "a good thing". I'll certainly agree about the powers not deligated to the federal govt by the constitution, nor prohitibed by it to the States comment, although not everyone in the flyover country understands it.

We have a local person who is on board with the KC Tenants crew. "They" managed to get themself on the city council. I bet they are not re-elected next year, but you never know. They are certainly not a property owner.

Either way, I'm just glad the Judges are starting to hear the cases and all of them so far are agreeing that the eviction moratoriums are not legal. We all knew that was the case, so why did they get away with it so far.

The issue is that the Federal Government cannot order the eviction moratorium on properties not already under federal control. Now, whether the States can do so inside their state borders, or a city can, is another situation entirely. That comes under a different set of laws. Still should not be legal, but a different set of judges will get to hear it first. --67.43.xxx.xxx

Update:

The U.S. Department of Justice has filed a notice of appeal to the DC Circuit of this morning’s ruling vacating the CDC’s eviction moratorium. They seek a stay of the decision, pending appeal.

Sigh.

Meanwhile, every employer I know of is hiring and can't get people to apply. The freaking gas station is offering $13.50 an hour. Restaurants are closing due to no employees willing to work. Even at $13 - $15 per hour. Remember, this is a place where a single person can get an efficiency for $350 - $395 per month all utilities included. Sigh. --67.43.xxx.xxx
