Just sent my first Notice to Quit in YEARS. Nice old lady (hah she might be younger than me, I don't know!) BUT with a felon son whose crimes go back decades. He keeps getting out on Parole and moving in to her (our) garage. She has a tiny studio upstairs but he has once again set up a bed and TV in the garage, despite our letting his Parole Officer know he was not allowed to live there.

She has also had her ex-husband living there (she says not, she says he comes for help with daily living BUT Dh walked in one day recently to make a repair she had requested and he was there, alone, asleep in the bed. And utilities are sky-high for just her.)

The son moving in: this is the third time - both other times he went to jail quickly so we let her stay - she is completely intimidated by him and she had a lease.

Now she is on M2M as we did not renew for just this reason: if he came back, we wanted her gone. She has 7 Days to leave: she has until Mother's Day (!) to get out or we file for a formal "holdover" eviction on day 10.

Spoke with the magistrate, she said verbal, text OR email is fine. I sent text AND email.

It's a 300 square foot studio ROG, barely legal but it IS fully permitted. The tenant also gets half the garage (wall built between sides) and a washer & dryer in there.

It's not in a great neighborhood, it's a truly comical looking property and it's not on the beach - about 15 minutes away. We have several houses up there though and get great rents but I can't even imagine what I could charge for this nowadays...I guess I'll find out!

What are the court cost in your area to file formal eviction papers? Here it is $247 to file (that gets the Constable to serve the UD papers) and then two weeks later another $50.00 for the judge to sign the Writ of Possession. Most uncontested evictions here can be done in

Roy, about $150 for one person, and Magistrate made it clear I didn't have to name her "guests" or serve them. That's for the Summary Ejectment hearing.

Writ of Possession: I have only done one in my entire LL career, and I don't remember what it cost.

This is the part of the job that frustrates me - not the notice itself but rather the steps I go thru to make sure that I have mined out a true gem resident - only to find out that there is added baggage.

This morning I get an email from said lady's ex-husband, telling me he knows commissioners and inspectors and health department people and that while he doesn't want to be confrontational, he also knows attorneys.

"Garage rented separately" is my system for my storage garages.

It's included in her lease because that's where the laundry room is. All she has to do is lock the dam door.

We have other properties where the garages are ours.

I'm still seething about her ex-husband's interference, threatening, bullying stance. Told me he's been in Real Estate for decades and knows everyone, to hear him tell it.

Apparently my pithy, rather well-worded response to his threats worked. He is now begging forgiveness and god blessing me and praying for both of us. I'm ignoring him.

I am, however, in touch with his ex-wife, our tenant, and we have worked out a deal. She leaves by end of May (she's paid the rent) no muss no fuss leaves it empty and clean and I will refund her security deposit as appropriate and no eviction on her record.

I will show the place with notice and she will ensure it's clean. She gave a list of things to be fixed (all wear & tear for sure.)
