'Mom And Pop' Landlords Dying On The Vine As Un-Evictable Tenants Enjoy Pandemic Protections

As millions of renters across America continue to benefit from sweeping protections against eviction during the COVID-19 pandemic, their landlords haven't been so fortunate.

According to Bloomberg, nearly $47 billion in rent relief from the Biden Administration has been slow to materialize, forcing "mom-and-pop" landlords into financial hardship - or forced to sell to wealthy investors. Bloomberg, perhaps to invoke sympathy for the landlord class, focused on the impact felt by minority landlords.

In one example, airport janitor Joaquin Villanueva has had to take out a home-equity loan to make ends meet while maintaining a three-unit rental house in East Boston. One of his tenants is eight months behind on rent, while another - an unemployed restaurant dish washer, owes him $5,000.

"I donít want to lose my house so Iím doing whatever I have to do," said Villanueva - an El Salvadorian immigrant who works at Logan International Airport, adding "Iím not rich like a Donald Trump."

Unfortunately for Eccles, "One tenant owes more than $40,000 in back rent, five units are empty and Eccles canít afford to replace or even fix a boiler that broke down again in March. The rent relief program will help only so much. Heís unlikely to get government grants to cover losses from a tenant who left in November owing $96,000."

Speaking first hand, everyone's situation is different and you don't always know how they got there. I recently had someone evicted who didn't pay for 13 months. It wasn't COVID related as proven in court but the court was closed because of the moratorium and finally opened in October with a huge back log and delays. The former tenant is mentally ill and irrational. There was no negotiating or reasoning with her, no cash for keys and it had to go through the court system. Anything else would not have worked without substantial consequences but I'm glad it's over, renovated and re-rented. --71.184.xxx.xx

Lynn, anyone who sits with a non paying tenant for 13 months is a fool. I could see somebody doing this who owns one or two rentals and has a plenty of other income. I could not see a full-time landlord who all they do is real estate letting someone sit in the unit for 13 months and not taking action on their own. --174.198.xx.xxx

"I never understood how people made money from rentals. Several friends have tried it, and they all suffered. One friend had a duplex and the tenant plugged up the bathtub and left the water running just before disappearing. The only successful endeavor was one where a friend partnered with a huge ex-con. This partner made sure that rents got collected, and problem tenants stopped being problems.

That's how we used to collect on const. contracts from developers, architects and lawyers. Even when they'd file bankruptcy.

Tiny and Little Boy, two very eloquent and refined motorcycle enthusiasts.

The government has no right to prevent evictions without compensating the owners. The entire "law" regarding evictions is malicious and violates human rights.

It's almost like any business that deals with the public at any level, such as a restaurant or rental properties, should be avoided like the plague. The owners have zero protections and their clientele totally run the show. Count me out."

So what do you suggest NE? What can you do legally,..so that tenant not only will get to stay but gain a lot of your assets in court?

Hostile governments like the previous Liberal provincial government ruined the secondary rental housing market where houses, townhouses and condominiums were sold to become owner occupied. Now vacancy rates are zero or one per cent on and off where tenants find rents are sky high along with there little to move in. Those who were holed at relatives or friends house are going to be staying there for a very long time as the minimum credit score is seven hundred or above. The more you tell a lie the more it becomes believable where not in reality where everyone knows more government intervention has a detrimental effect on the rental housing market where tenants pay above market rent where there are options. I wonder if there's any business opportunity in going to these landlords, offering a discounted but guaranteed rent to sublet it to tenants. Use their rent to pay your rent, and keep the excess.

Would be a cheap way to expand your portfolio, and the landlord who owns the place would get a guaranteed but discounted rent.

Yeahhh NE,..you still avoid answering the questions and spouting vague philosophies. The problem is they ,the courts and government have the power, whether you like it or not.

You can accuse people kneeling to that power, but its their power, and they can and will use it. I was on the other side of a ridiculous lawsuit, and by the time it was over I was 35K lighter with lawyers charges, court costs and the fact the judge felt sorry of this single parent lady and awarded her some of that.

As my lawyers said if I didn't agree to setting I might well lose the building.Yes I could stand out on the street jumping up and down , wildly waving my arms screaming "unfair, unfair",..but it would have done no good.

And all that is with really not doing something grossly illegal. Tenants can easily get contingency lawyers that know how to draw things out to get a settlement,

You might THINK you have the power, but you really don't. Your vague answers don't help much,

Lynn, if you are not collecting rent because of the CDC moratorium then you need to look at the guidelines and other post on here. The tenants are required to prove certain things, 5 things I believe and you can evict for other reasons.

guys,every state had different rules,us in wis where to evict when courts opened up.we lost,normal eviction of 1 month took 6.lost 5 month on tenant.offered over 500 to 4 different tenants for cash for keys program.received over 60,000 in goverent money rent assistance programs.but the one thing that pissed me off the most was property taxes.we could not kick people out and could not charge late fees.but our company normaly payes all are taxes of over 200,000 before the end of year.but with not collecting all are rent and waiting for the gov money,we paid taxes late.and me as landlord had to pay late fee on taxes.i thought that was the biggest crock.but to blame other landlords not the way to go.we need to blame the poeple we elect.we are so down on the list to our reps,i think only one behind a landlord is are men in blue.
