I just last evening saw a post on you tube that Texas is starting evictions in defiance of the feds /CDC telling them no. Several other states seem to be wanting to follow. It should be interesting and about time, in my opinion.

Hope that those who are able to pay rent get evicted along with those who are on government programs start to work on rent arrears. Governments have made a bad situation worse by allowing this to drag on too long where rent arrears have reached the point where people will be unable to pay rent arrears. Now depending on who is going to win this fight between two levels of government. People here were receiving $450 CDN. per week in UI where some claim that is too low. That should cover rent, food in most cases except in some larger urban areas. You can be sure people are paying mortgage payments. If evictions start then we are going to see what the reality is going to be after the majority of people receive vaccines. Our local rent moratorium is scheduled to end July 1. I anticipate many of those who have not been paying rent, will suddenly decide to move out during the night of June 30th and never been seen again, no forwarding, new phone numbers, etc., so Landlords will have no way to recoup any of the lost rent money. Massive evictions will be filed, with no place to serve the paperwork. I think it's going to be a really bad time for Landlords who got stiffed. --174.68.xx.xxx

So they are bucking the CDC moratorium? The reason I ask is in Missouri we've been full steam ahead on evictions since May 2020 when our courthouse reopened, in spite of anything that came out of Washington DC.

The CDC moratorium is the only nation-wide eviction overreach I'm aware of at the moment. And as long as judges are ruling on it over-broadly, it should be easy to still evict most non-payers and 100% of folks who are otherwise lease violators. In short, it has almost no teeth unless local judges are proactively expanding it well beyond its actual scope.

Yes Sid, the Texas Supreme Court order expired and as a result they issued direction that lower courts are no longer authorized to halt evictions based on the CDC moratorium. So you can proceed with evictions even if the form was submitted to the court.

An advisory issued by the FTC and the Consumer Financial Protection Bureau states they “will be monitoring eviction practices – particularly by major multistate landlords, eviction management services, and private equity firms – to ensure companies are complying with the law.”

We'll see if they try and enforce the penalties identified in the CDC moratorium. So far there have been no cases filed by the FTC or the CFPB. Pretty sure in poker language the bluff was just called. Now we'll see what cards are rolled over. --64.130.xx.xx

It's not going to be a bad time for landlords. They've been living without that money for about a year now. If anything, the only tough time will be funding all the legal fees and remodeling to rerent. But at least there's going to be a silver lining afterwards.

The deadbeats who soon discover they have nowhere to go will be the ones suffering. Landlords just learned a harsh lesson in screening. They aren't going to just rent to anyone after they get the non-payer out after a year long struggle. --108.69.xxx.xxx

It was "about time" to end it about 30 seconds after they enacted it over a year ago! I hope if we ever have a real pandemic that the government doesn't use real estate as a cure again. Veering a bit off topic, but knowing how creative American entrepreneurs are. I expect that about 60 seconds after the eviction ban is lifted, there will be a dozen websites where tenants can purchase all of the paperwork showing that they have been excellent tenants who paid rent all along.
