I am in Georgia and Court Evictions are backed up. The county stopped taking any new cases for hearing on January 1st (because of Covid) and resumed hearing in late February.
I had filed eviction on January 15 (for non-payment of rent) and I am told that it is still not on court's calendar as they are still finishing late December cases.
This has been an unusual delay and the tenant is having a free ride. He knows about the delays. He has actually moved out late February but not willing to hand over the keys until formal eviction happens through Sheriff. He occasionally drops in once in 2 weeks to check whether I have changed locks or touched his belongings.
At this rate, it appears that it would be May or sometime in June when I will get the hearing. So technically, I lost rent for 6 months, Jan through May/June.
What options do I have?

I’m in Georgia as well, I’m going through the same thing but in your case if your tenant has turned off all their utilities and moved out they have abandoned the property and you can legally take it over. Just show proof where they have called utility companies to turn off their utilities and you can move him out for abandonment. --99.28.xxx.xxx |

Just for laughs I had my "Property Tax Advisor" contact the County Tax Assessor. My advisor told the Assessor that I won't be able to make all of my Property Tax Payments, I'll be around $100,000 short, due to tenants having Covid-19 protections and Evictions have been stopped until NEXT YEAR!
The Assessor said that I will be charged a penalty, late fee plus interest. And if those payments aren't made in a timely manner, they will take legal action against me, which could include foreclosure/seizure.

Mostly peaceful squatters occupied the property since no one was there. They may have stolen and sold all the things there. Can't tell for sure as you don't know what was there. They stole and destroyed any mail/what mail? And the mailbox as well. If/when someone else showed up and said they were a tenant, the squatters "defended themselves" from an attack by a deranged racist. (Be sure to get video and post it.) In the melee that occurred, the supposed tenant was severely injured, both arms and both legs broken in multiple places and their car destroyed and torched and the squatters sued him as well.
I hear it happens all the time in big cities.

Barbara, you're probably right. Equal justice and all.
You have a few options. Fix and re-rent. Give the tenants new locks and keep a key. Tell them to change them. Not my preferred route, cuz I'd just change the locks. Or call the cops for a welfare check and film it in abandoned condition.
This is a risk vs reward decision. How much $ in lost rent vs how much $ in trouble you get in.

Not all states have abandonment laws so you might need to build a case that the resident doesn't actually live there any longer. Take lots of photos
If utilities are off and there no toilet paper or food in the house you can post the place as abandoned siting utilities, lack of rent and facilities at the unit.
Then request the tenant to contact you to correct these issues so it will not be deemed abandoned. Do you suppose the person is going to pay you the rent or turn the utilities on on? --24.154.xx.x |

I am going to give another month, May 2021. I am hoping that the court date will come up and I will have eviction. Then use the court judgement to recover all past due rent till the time of eviction and send to his employer for garnishment. Not sure, how successful I will be in garnishing.
Actually, the guy may have worked as para legal or knows someone who works as clerk in county. He is well aware of laws and is playing a tough game.

Please answer the question about if utilities were shut off. It would be helpful to shape answers for you.
Why is he trying to make your life so difficult?
Have you pissed him off royally in the past? Like maybe not answered basic questions that could make his and your life easier? Can you sit down with him and have a real conversation?
If you know where he works, can you speak to his boss or coworkers and explain the situation that he is a vindictive deadbeat and ask that they talk to him?
Can you go over his emergency contact list and tell his Mom how he is behaving?
