Hi good afternoon everyone, hope that you all and your family are well and safe.
I just wanted to read about what happen before and after your X times a year inspection, when you go to the house with all your gears, after you complete this, do you give a copy to the tenant ?

Just want to know a little bit more about your experiences, the tenant that i have right now in my second floor, has not break my house, always pay on time, but there is a small detail that is making me thing that there is a STRONG POSSIBILITY of not renewing to them this year: LACK OF CLEANLINESS... Some of my doors that were white, now are some in between beige and cream, the door trims, specially on top, has some grease stain (the one close to the kitchen), the opposite side of the stove has some water marks, the microwave is nasty as F... One small closet next to the Dinning room has some mice feces (AGAIN) ... And Yes i hired a pest control and they have not complain about Mice again... Oh the trash and the recycling, i have to check them almost every other day, they put trash in the recycle, bags, recycling in the trash... Whole Boxes, they do not rip them off... I have another extra container to use when the provided city containers are full, they don't put trash bags outside in the floor to prevent call the attention of critters and rodents, but they keep doing opposites, i can't be babysitting... Their main language is not English... I don't want to be picky, but i was living in the second floor and i know the condition i left the house, 1A+, the white was white, the shine was shine...
Yes i have talk and text to them about this things...
So i wanted to know if you provide a copy after you do your inspections??
And besides that, at the inspection time or at another time, do you ever ask them about how they feel at the property, if everything is in proper working conditions, if anything needs to be fixed, addressed or something? I am asking this because i think that in the case they want to take me to court if i don't want to renew them, and when we are in the Court they start lying: he never did this, he never took care of that, this was broken for the longest time, etc etc etc...

It is always a good idea to have an impromptu inspection - this reveals unauthorized animals resulting in some nice fees if you have it in your lease. No sharing of anything until the property manager and owner have each reviewed what steps are taken as a followup to the -property- condition, it has little to do with the people unless someone has allowed them to drive over top of the manager, get a new manager and enforce the lease.. --76.188.xxx.xxx |

It sounds like you will need to evict them (when you are ready) due to this problem, so you absolutely DO need to have it documented.
It should be in your rental agreement that they must keep the premises in clean condition, and dispose of trash properly.
Any time that you see them in violation, notify them IN WRITING and create a paper trail of proof. You can then show the judge how many chances you gave them to change their ways, until you just had no choice but to ask them to move.
Now, somebody with these habits(in my experience) is probably not going to change. Even if they make some effort and do better for a while, it's just their "natural" way of living that they will slide back into.
If you want to keep them because they pay their rent, OK. The damage is already done, and you will have to fix it when they leave. So, you may want to just let them live there as long as possible, in their own dirt.
However, if they are leaving trash around that draws pests, this affects their neighbors, too. You might need to increase their rent to the point where it is worthwhile for someone to go over & check/ clean up outside once in a while.

-Vee sorry for my lack of knowledge, but who does the impromptu inspection? The owner/me? Or any specialized person? This is the 1st time i read that term. I have no property manager, i live here, in the 1st floor, they are renting the 2nd floor, they have a 1 year lease due on September 2021.
-DJ that is why i am asking to make sure i am documenting it the right way, i am getting ready in case we need to go that road, since i have never evict someone, i don't have that much experience, and i just have this multi-family.
Yes it is in our Lease agreement the cleanliness and the trash and i had provide them of papers showing how to properly dispose the trash...
I notify them via text, should i start sending letter ? And i have picture of the BEFORE and AFTER...
Yes i was thinking about this habit things, if that is their habit, i just want to make sure i am making the correct decision, i post something here about 4 month ago about my 3rd floor tenant that move out due to this mice infestation that started 3 days later after the 2nd floor tenant moved in and i am a person that does not believe in coincidences...
From Dec 2019 thru Sept 2020 i had that second floor empty and depleted my savings, i am recouping now, i am really unsure if keeping them due to this Pandemic thing it has been really difficult to find a tenant in my area able to pay 1st, Last and Security Dep, the rent is 1900, 3 bedrooms, 1 bathroom, living room, kitchen, dinning, no parking unless is on the street... I had recently paid 18k to replace 2 steam boilers, even thought due to a mess on the job, they reimbursed me but eventually i need to finish or correct that job, so i am not counting with that money, and i am replacing my windows...
But thanks for the input, i have to sit down with my wife to weight everything...

Congrats on planning to do the inspection. For me, I do not give them a copy of the "complete" results, as some of the items are not related to them staying there nor are they their fault...just things I want to document or fix for my own benefit. For example, if I notice rotted fascia boards that I'll want to do within the next 1-2 years, I don't want to share that with them.
But, anything you are going to charge them for or ask them to fix/change you should give them at least a bullet point list of. I would also include photos and exactly what your expectations are including a date by which you want things done or paid for. By doing this, you have a record you can use when they move out or if things get messy and it goes to court.
Think in terms of:
1) Issue identified
2) Action requested and by whom

LordZen, when exactly are you planning to take your vacation, this fall or next year? If you're going to be on vacation this fall, I might be inclined to renew these tenants with either a 6 month tenancy or perhaps MTM so someone is living at the property & paying rent. Having them in there will help get you through the next heating season. You definitely don't want to be away during the heating season without at least one of your units being occupied. Also I doubt that their unit will require much more effort to make ready for a new tenant whether it's done in October or next March.
As far as their lack of cleanliness goes, is it possibly a cultural thing, a lack of knowing what to do or are they just slobs? In regards to communicating with them & documenting things, I suggest that you don't just rely on texts but also use Emails & letters. Something that I do with tenants who aren't fluent in English is add a statement at the top of every correspondence in English & in their native language along the lines of "This is an important document if you do not understand it, I recommend finding someone to explain it to you". I have a few tenants who rely on their kids to act as interpreters which works OK most of the time. However when it doesn't I require them to find an adult whom can be there in person to act as their interpreter.
Hopefully in your rental agreement you have a clause along the lines of "All request for maintenance and / or repairs must be made in writing". I would think that requirement along with the statement of condition that you provided when you took their SD as well as any pictures you take during your routine inspections should cover any issues that may arise in court.
PS now that we are just about at the end of our heating season (September 15 through June 15, inclusive) you should be formulating a plan to get your heating systems in good working order.

-Steve my friend good afternoon, thanks as always for your valuable feedback! We are planning to go at the end of Fall if God let us. And we want to go this year because we have plans in mind that if we don't go this year, the next 2 years is likely that we won't be able to go if we succeed with the plans...
I add that statement since the last time you give me that idea, but they always come to me with a very close friend of the family that speak more English than them but he also come from the same background... I want to be polite and cooperative, but i don't wanted to be speaking like i am speaking to a 10 year old kid, except when is MY KIDS hehehe. They have a tennager like 13 or 14 who understand more English than them, but they don't rely much on him, i don't know why.
Yes i have that statement about the repairment request, but as for today, they haven't made any request to fix anything, anything that i had fix is because i had been there frequently to check or one thing or another...
They signed the condition statement showing every detail of the condition of the house that WAS IN PRISTINE CONDITIONS.
Believe me i had been making calls, some inputs and recommendations from Heating Help, one is from Springfield and he does not come to my area, another one has a long waiting list and i have been waiting 3 weeks, and if i want expedite services i have to pay 500 hundreds, that is not include in any services that they might need to do, and expedite does not tell me if that means they will be here tomorrow, 2 days...
Call another 2 and they are way too busy and refer me to someone else, this person came 2 weeks ago and was supposed to send me a quote of what needs to be done... I am waiting, i called he said he has not received a response from the email or quote that he requested to she supply company about the materials he will need...
He said i don't need to replace the boilers and i don't really want to because these are new and they are working fine, my only problem is the PIPING :( but let's see...
