Hello,

In Ohio, If a tenant (roommate in this situation) paid rent electronically during the entire tenancy, can I insist on him providing me the forwarding address to send back his security deposit by mail?

I am trying to find out his current residency to protect myself in the event he were to retaliate in any way.

I gave him a 30-day notice because he was beginning to be disrespectful and defiant to me.

He will only be receiving around ~$110 out of a $400 security deposit due to the damages he caused in the room (of which I'm currently itemizing in a letter I'm preparing).

With how much I know of his personality and the kind of person he is, I expect him to be furious and threatening. For this reason, I want to know where he resides if he were to try and do something to me or my properties. He has already implicitly expressed expectation that the SD would be returned electronically (we have not discussed how it would be returned verbally or in the lease prior to this).

Anyone have any thoughts on how I may go about this? Or should I email him the letter and electronically return the deposit? Input appreciated.

Ohio law mentions, "The tenant shall provide the landlord in writing with a forwarding address or new address to which the written notice and amount due from the landlord may be sent. If the tenant fails to provide the landlord with the forwarding or new address as required, the tenant shall not be entitled to damages or attorneys fees under division (C) of this section." - Section 5321.16 --208.102.xxx.xxx

The law as you wrote it seems clear. He needs to provide you with his new address.

If not, remind him to be sure to set up mail forwarding at the post office & send it to the last known address (your rental). You will be able to get the forwarding address from the post office, but don't tell him that. --68.229.xxx.xxx

Try using the green card USPS service to send back the accounting statement - you have 30 days to follow OH 5321, if the package is returned unclaimed then you must hold it sealed for 7 years. --76.188.xxx.xxx

If he doesn't elect to give you his forwarding address, just send it to the last known address that he had - your place.

when he returns the keys he signs a memo of vacancy stating he has removed all property of value and is returning possession to the landlord. i use the following language which is very calif specific:

All persons residing at the property have vacated and we hereby return possession to the owner/landlord. No persons besides those signing below had residency at the property.

We have removed all personal property of value.

All debris, material and personal property, if any, remaining at the property is hereby abandoned and valueless and may be disposed of, donated or given away without any further notice, per the terms of the lease and as the landlord see's fit.

We timely received the landlords move out memo regarding pre-moving inspections, inspection remarks if we elected an inspection, and the disposition of our security deposit as required by the civil code section 1950.5

The property is now entirely vacated. Possession is returned to the landlord.

The mailing address for purposes of the deposit accounting and correspondence is: --75.80.xx.xx
