Hello All -

Short version -

Just had a tenant issue a stop payment on an ACH rent payment, but deposit manually at bank making reconciliation much harder. Who here has dealt with that and how?

Longer version -

A struggling tenant took on a roommate that screened ok to split rent. Prior the tenant paid with an internal bank transfer as she has been with us for 3-4 years and while we didn't specifically state it was allowed, the bank figured it out and it worked. Fast forward to a couple months ago, roommate never had enough funds to pay and new lease stipulated ACH. Took a while for the original tenant to stop the internal transfer, and the ACH ran concurrently. The total rent was paid by the original tenant as the roommate ACH failed.

Well this month we didn't ACH the roomy as there aren't third chances. They both went into the bank and did manual deposits and at the advice of the bank did a stop payment on a contractually authorized ACH.

The problem with manual deposits/transfers is that the bank doesn't reliably record who makes the deposit. Another reason we've moved to ACH.

The biggest problem is she didn't notify us to stop payment, or we would have.

Second - both of their accounts are not able to be debited after the NSFs and now the stop payment. They were struggling already and will not want to pay the processing fee.

I already have a rough plan but curious what the wisdom here says..

While it is not best arrangement where hope as long rent is being paid then can continue during the pandemic crisis. A lot of minimum wage jobs people do not earn enough to live decently where there is no easy answer here where people may need a government subsidy to live. Many areas minimum wages has not keep up with inflation or provides enough to live off. Over the next few months hope most people start to get to vaccinated where the pandemic effects will start to move down. Can not believe people rely on Face book where spoke to many different doctors where the effects of getting Covid 19 are much worse then the side effects of a vaccine. Remember when went to public school they brought you into a class room then gave polio vaccine shots no questions just done where now polio is history. Depends on what you want and what GA allows. Your lease states ACH, is that grounds to evict over lease violations. They have trouble paying every month, maybe it is time to suggest they find a more affordable place and let them out of your lease. Or we have an eviction moratorium for non-payment so move them to weekly or bi-weekly and take the rent any way you can get it for the time being. --75.67.xxx.xxx

It seems that you have tried several different modifications and now you are assured that this tenant and roommate should not have passed screening. Make notes and apply lessons learned to the next batch of applicants that you will be screening as soon as these people vacate.

As for the roommate canceling the ACH, this is a clear violation of the terms of the lease. You are finished trying to accommodate them.

On the account statement you prepare after move out be sure to include all lease payments to end of lease, cleaning, repairs, deductions for deposit...send both parties this statement. If not paid, get your judgement, collect.

As long as they continue to pay, I wouldn't automatically evict.

Do you have hefty late fees? Not only to discourage late payments, but you should be compensated for tenant's bad behavior.

ZT. Be absolutely certain tenants understand that if all money due is not received by a certain day, then you will file for eviction. For me, it's the 6th.

There are ways to easily manage manual deposits. One of my guys takes a photo of the deposit receipt and texts it to me. --107.141.xx.xxx

There is a time to play hard ball and there is a time not to. With all the COVID restrictions in place - will hard ball get you the results you want? It seems like they are attempting to right a wrong. This is not the ideal situation - which is not to have any wrongs.

You are a manager, you apply the grease that keeps the wheels going around.

If their set back is some how tied to C-19, you might want to consider helping them apply for help. Then again, if these folks have been that big of a pain to deal with, you might want to move them along. It is really your judgement call. One payment for rent no matter how many tenants. Up to the tenants to pay their share to the main tenant. You cannot evict one room mate for not paying his/her share. you evict all for non-payment. So you have 3-4 tenants in one house, and need to collect from each? NOOOOOO!! I roomed with three others on at Newport Beach and paid the one in charge. --174.26.xxx.xx
