State Specific Question About: ARKANSAS (AR)

If a tenant notice that stray bullets has entered their apartment and wants to break their lease and move because they are scared, nervous, and cant sleep. Would you refund their deposit or not. It is a year lease and they have only lived their for 3 months. --108.239.xx.xx

I dont think it was intentional people are always shooting in the air or just to be shooting i think it was just stray bullets. So we really dont think anyone is after her. --108.239.xx.xx

First go and look at the place and make sure it was stray bullets. Did they come in through the walls or windows/doors?

Or were they fired inside instead? Did tenant shoot back?

Then find out why this happened.Ask around the neighborhood. Neighbors and especially kids will likely know what happened and why. Drugs? Gang activity? Domestic violence? Crazy ex ? Possibly it was about previous tenants and had nothing to do with current tenant?

Check police reports. You would think if that happened, there would be police reports. Anything on the TV/radio?

If tenant is telling the truth, they will likely move out no matter what.

Plus, in many cities, tenants can just move for this or domestic abuse with little or no penalty.

If there is nothing you can find, consider that tenant may have received a fat govt check recently and decided to move because they now have money. I've been contacted by one of my tenants and this is the situation. They got a fat tax refund and now want to suddenly buy. --24.180.xx.xx

Tough problem. I would require a current police report from the tenant. Not an afterthought-- when it happened date.

Since only 3 months should be rent ready-- but they must move NOW not in a week or two. NOW. Since they are in fear that shouldn't be a problem????

I always just let people go because making them stay would be a problem especially if they started to destroy things in the home. Possibly this person only wanted to stay that length of time and lied to you at the start. I would go look for bullet holes to see if they were from outside or inside and if tenant did not call police, you do it. --108.24.xx.xx

Maybe things are different in Arkansas, but I would not consider random bullets going into an apartment a normal thing that is always happening. I agree with other comments to verify what happened, but if it is as tenant described I would let them out of lease. --184.59.xxx.xx

Let's look at this 3 ways.

Tenant noticed stray bullets as in they were not home but perhaps are familiar with such situations or tenant was home and is scared of the new neighborhood and wants out, or this is not news to you house is in a bad area. First implies trouble follows tenant, 2nd implies they want to better themselves, 3rd implies its time to sell perhaps?

Requst a foil report from the pd and you will find out if they have been called to your address for your tenant.

Me, I'd let them out if it's sincere and return funds after the place is verified spotless. I've had prospects who want to better themselves and move away from violent neighborhoods. Unfortunately they have not qualified. I think it's a good quality in a prospect.

I also would not want you own a home in an area like that. I used to work in the hood. Not that I felt unsafe but I was almost shot by a stray bullet the came from around a corner. Missed Me by ten feet and hit a young woman in the tummy. Guys gathered around and surmised it wasn't so bad since it's from a 22. Clearly at lest one of them had been shot before. The volunteer ambulance was a block away, came quickly.
