A 5day notice was posted and taken in. I did not send a registered or certified copy. The 5 day is expired do I need to do a new one? Or can I send a copy of the original? Its been so long I've forgotten the process!!! I feel so dumb. Husband had a stroke and I'm in free fall!! --98.220.xxx.xxx |

What did you say would happen in your 5 day notice? If they don't vacate or pay the rent, then you need to move forward with the eviction. You don't have to send the notice registered or certified, but if you hand delivered it, the court will require an affidavit to that effect. If you just sent it in the mail, that could be an issue. Hire an attorney especially now since many states you can NOT evict for non-payment.
I’ve run into a brick wall on evictions. They can stay for free until the government lifts the no evictions for non-payment.
Also if I do it myself (pre-covid) I get the forms required by the courthouse-justice of the peace in my little rural town and fill them out, send registered and place a copy on the front door, take a photo of it on their front door and text them a copy.

Why are you evicting Caryl? Knowing the reason would help us give you better advice.
If not about rent, depending on how long your lease is and what it says, you may need to post a 14 day after the 5 day. I do not believe that you need to send a copy certified or registered but just by regular mail. If you send certified, they probably won't pick it up. Mine didn't and I just got it returned to me. Luckily I know they got it. With the 5 day, you cannot count the day you posted, any weekend days or holidays in the count.
Milwaukee may have some more strict laws on eviction (not due to the pandemic necessarily but that may come into place.
I would suggest going to the Wisconsin Circuit Court Access website and look for info on the process including basic small claims, eviction and service information.
Again we would need to know why you are evicting. The other thing you could do, which is what I did, is, if it is month or month or close to the end of the lease, you can just give notice that you are not renewing the lease and then in 30 days from the notice, if that is in your lease, you can just file small claims if they don't move after the 30 or 60 days or whatever your lease says.
It is too much to put it all here.

Thanks Cat. It is for nonpayment of rent and now unanswered texts and expletives if I call either of 2 phone#'s. I work with tenants but the hole is getting deep...these are strange times for all. I like the 28 day idea and will pursue that and see what happens. Would you know if that can be mailed to serve? I am out of state and would like to get this rolling before the 1st. I really appreciate your response and your kind thoughts. Caryl
