I am selling a property out of state and am under contract. The ad now reads that it is off the market. I questioned my realtor on it because my attorney had said to continue showings until we are sitting at settlement. The realtor told me that they are not allowed to show it under MLS and it would be unethical. Really? You can't put a Pending on it? I questioned him several times that if this deal falls through, I have to start all over again. Guaranteed it won't be relisted through them- of course waiting until after they get no commission. Every call I make to the attorney costs me money, if I push for showing and get none-I have no control over it, I paid the attorney for nothing or I get a back up plan that might be better in the spring when I am no longer with the realtor company.. A whole lot of what ifs.. Settlement should be in 5 weeks, IF they get the mortgage, IF the appraisal is correct...I wouldn't do this deal again. --73.230.xxx.xx

It is just frustrating all around. I will be calling other realtors this morning to get their take on it. My realtor loses commission if it doesn't go through. I am not not sure why he doesn't have another plan. --73.230.xxx.xx

Are they preappr Bed and do you know the value of what you're selling? That should eliminate those 2 issues. It may be state specifs whether or not you can continue to show after sales contract is signed. In Pa we can, but I see it mostly as a waste of time. Often if it's vacant, I'll just give the buyers the code and they can walk through if they want.

You’re probably under a contract with your real estate agent on the property that gives them the right to sell. That’s typically how things work so you wouldn’t be able to fire them mid-deal. You can report them to the local real estate licensing board though. --73.186.xxx.xxx

Yes, they have the right to sell but no deal is done until settlement is over. I won't fire mid deal-just won't resign with them.

I just don't understand why we have to wait to see if we settle instead of looking at all options. Not saying to bail on the contracted people-just to keep showing it. I won't be using them again and they won't get a part of the commission if it is sold within X amount of months. I guess that is the good part-THEY took it off so no one else sees it. --73.230.xxx.xx

To keep showing and build a buyer list is fine if the deal falls through. I highly doubt you can pul the contract and go with a better buyer if one comes along. At least not without VERY specific wording in the first contract. One of the goals when I buy is to get the contract signed asap because a seller can't back out in PA. --70.44.xxx.xx

Expectations should all be laid out in your Broker/Salesperson contract. If you expected continued showings up thru successful closing or the end of contract, that should be addressed specifically. If it is not addressed and they are simply ignoring your instructions, one might be able to argue they are not acting in your best fiduciary interest to attempt to secure a backup offer in case the primary offer falls thru. That would violate their duty as your agent.

I find the best way to head off problems is to clearly outline all expectations and contingencies up front, before contracts are signed. Sadly, that often doesn't happen and people just figure "good enough" to go with whatever the default expectation is, and they end up disappointed when their default isn't the same as the other party's default. I would carefully explain to the agent that it is not unethical to attempt to secure a backup offer, and if the agent still refuses and the deal falls thru without a back up, you will leave review/feedback for others to take into consideration before hiring said agent. That's about your only leverage at this point, and a wise agent realizes that most business comes from work-of-mouth referrals.

Might give a call to the office manager/broker if you get an unsatisfactory response from your agent. He/she may not be up to speed on actual agency requirements. They don't cover a lot of practical "What ifs" in real estate licensure course.

in my area they mark it as "pending" or "contingent" - not sure what the difference is. That way, other potential buyers know what's going on. You can still show it and then if the first deal doesn't go through, someone else potentially could be waiting with a contract immediately. --72.70.xxx.xxx

In the where I am selling, there is no earnest money. Another reason to keep it on the market. I tried with both the attorney and my realtor-the better offer is not something they do either. I know that you can put whatever in a contract but this is ridiculous with their "we don't do that here...".

That is part of the reason I just want it done so it is over. I see too many what ifs down the road. In hindsight, I should have taken the cash offer of $20,000 less but I would be done and not have to go through all of this. --73.230.xxx.xx

The local MLS has two categories for pending:

PSS - pending but still showing

PND - pending no longer showing

All I asked is for it to be listed as Pending at least. Most of us know, it is not over until it is over. If it falls through, I am out 2 months of potential buyers. It could fall through tomorrow for all I know, they could lose an income..

So to answer a few of the other answers on here such as 'what is the difference between Pending and Contingent'..

Pending is that the property is PENDING to be sold (typically "all hurdles" have been completed and they are just waiting for the closing).

Contingent is that there are CONTINGENCIES in place still on the contract (such as waiting on the mortgage commitment, any inspections, etc). Once those happen, then it moves (typically) to a Pending status until the closing happens which then it moves to Closed (or Sold).

Most buyers are not interested in looking at any properties that have offers already accepted on them unless they've already seen the property and want to make a "BACK UP OFFER". That is the ONLY way that you would be able to get anyone else "in the pipeline" for this.

So basically, if it's newly sold - which it sounds like it may be, there are still financing "concerns" (they are pre-qualified but they are waiting for the bank to give them the commitment "Yes, I will lend them the money to pay for the property", in essence).

The RE Agent can certainly keep the property in a "contingent state" if the Attorney is requesting it (or you). Most likely they will (and should) place in the private remarks/ broker comments (where only agents will see it) that there is an accepted offer and no other contingencies need to be met however, the attorney is requesting that the property stay on the market and be shown type comment. Yes, they need to disclose this - so don't ask them NOT to.

I think you are getting ahead of yourself and worrying about something that you don't need to at the moment. Let them do their job that you hired them for. And do not think for a second that you are not going to pay them - they will and should sue you. You will not be able to just "get out of the contract" with them OR the buyer regardless of what you think since EVERYONE can sue you and either make you sell and/or charge you for their costs, including attorney fees.

Stop worrying ... the Realtor is going through the same thing most likely ("nervous" until the property is actually trading hands) but doesn't say anything to you because they are trying to keep you calm. Just sit back, relax and enjoy the fact that you will no longer own that property in a short time.

I see that you got the agent to "agree to show it until the sale" but I'm telling you - they should be until the property has not other contingencies (which the last one should be the commitment from the bank) and then move it to "no showings" ... but if you or your attorney feel that you want it shown until you are all at the table, so be it... you will not get any buyers though ... don't be surprised. If anything, they (agents) usually get the "if it doesn't go through, call me" ... very rare that anyone actually will go in and put a back up offer on it. --67.242.xx.xx

To clarify: When the contract is up, I will not use them if it does not go through. Most realtors have a clause that if it is sold within X amount of days or to someone who has seen it prior, they get a cut-that is what I am talking about.

OF course not it is in the "process".

It will be best to relist after X time with someone else so it looks like it just went on the market.

No-I do not wait well-this is not how we do it here. I don't have the familiarity to just get something fixed. Not sure of the reputable people there. First attorney I had there, I had to fire within 24 hours. "Family" attorney-wanted way too much commission. --73.230.xxx.xx

Make sure you thoroughly understand the listing agreement and your expectations are within the listing contract you signed.

Same for a Buy/Sell.

If the RE agent says - well this is how we do it - that is a big Red Flag.

For me if I don't feel completely satisfied with a deal or the principals I am dealing with - I wait - assuming you have valid reasons for waiting - sometimes you miss out for being slow - but in the end you are not second guessing your self. --184.21.xx.xx

Don't sweat it, let the process work itself out. Besides, sure, you can advertise that it's still showing, but in my experience, no one is going to see it. No agent is going to take their clients to a home that has a buyer under contract. Why get the buyers interested in a house that already has a buyer when there are so many others to choose from? Maybe a buyer who saw the house before the offer was accepted may put an offer in, but I doubt you'll get new buyers. Basically, even if you still show it, no one will want to see it because it's already sold in their minds. --108.69.xxx.xxx

MC(PA) - thanks for posting this - I didn't know that a seller could ask for the PSS status in PA. I'm glad now that my MIL's house, sold last June, had a buyer who was superbly qualified and carried through (didn't even quibble about minor home inspector issues because a home warranty was included).
