Do landlord have to remove snow on the road?
We have townhouses in small subdivision, and small road.
I do not think anyone own the road, the road repair and snow removal not covered by county for some reason. we fixed the road on the main entrance and a small road to our townhomes.
Today a tenant called the fire Mashal complaining the snow and fire truck not abe to come. Of course the fire marshal called me and want me to remove the snow to vocer his problem.
I will be happy to pay my share snow removal. if the fire marshal makes every owner pay their share.
The tenant is trouble make and argure everything and always parking on visitor spot and vacant unit spot. The tenant just there 1 year and lease renew 3/1/2021. I did not give him 30day notice not renew. But I told him to move out if he is not happy several times
I do not know what to do?

You need to find out who owns the road. Check with your city or county assessors office. They will know, since the owner pays any taxes. If the road is owned by the city or county, they should provide plowing services. Otherwise the private owner will be responsible. --71.233.xxx.xx |

I'm not really understanding. If it's a condo association type unit, the association pays.... not individual property owners. Say 10 houses - would everyone be responsible to shovel 10 feet of the 100 foot roadway? It doesn't work that way when you have private roads in a community. (not talking about private shared road agreements in rural type areas).
If it's actually your driveway and not the public roadway, that's in your agreement with the association who is responsible. The only association I own property in says more than 2-3 inches they take care of it. Less than that, it's my responsibility.
Go to the next meeting, contact the management company, contact the board as a whole and tell them what the fire chief told you. Should there be another time, don't even discuss something like this with someone - tell them to contact the board/management company/whoever.
As usual, I think something is missing in this scenario. --72.70.xxx.xxx |

"I do not think there is association."
Really doesn't matter. Some entity (association, builder, maybe you) owns the road. That entity is responsible for making the road passable for fire trucks. That entity will get the fine for not plowing the road.
One way to play this is to simply ignore it. If you don't own the road then you won't directly be held liable. But depending on how the road is owned, you might have liability. As a small step, you might want to find out who owns the road. Ignorance is not a good strategy. --71.233.xxx.xx |

I am not sure that the owner of the road has a legal obligation to remove the snow. Who says there is such an obligation? When I was a kid, the public street was left unplowed; our local gov't denied that it was legally obligated to plow. The snowfall was "an act of God," and the Town could let it wait until they got good and ready to plow it.
CJ, I would not get into a p!ssing contest with the Fire Marshal or the Tenant or anyone else here. Ignore it until you have to address it -- that is, ignore it unless you get some kind of formal notice from the Fire Marshal, other gov't official or a court.

There was a situation similar to yours a little while back.
No one knew who owned the road and taxes did not get paid.
The road went up for tax sale.
I thought about buying it and then putting up a toll road pay me here building.
Can you imagine what the home owners would have thought having a pay a toll each time they left their house or came home.
Maybe you should buy the road

Where is it written that I, as owner of street, have a legal obligation to keep it travelable and safe for emergency vehicles?
Do not ask the Tenant to plow or shovel the street. Do not ask the Tenant to shovel the driveway or the pathway to the front door or anything else. Do not pay him to do any of these things. The Tenant can stay inside, I don't care. If he wants to shovel snow, that is his decision, and you do not pay him for it.

Absolutely incorrect. It is owned by someone, or some entity (county, city, private company, association). You can easily find out the owner, and you should do so. For all you know it is you, and if so you will be on the receiving end of the fine from the fire department. --71.233.xxx.xx |

CJ, I disagree with some of the responses. If I were you, I would not care who owns the road, and I would not do any research or waste any time or energy looking into it. Just tell the Tenant that you are not plowing and that God put the snow down and He will melt it at his own convenience. End of story.
The suggestion that you quitclaim the road to the Tenant was facetious -- that means "not serious" -- it was intended to be funny. Some of the members do not recall that your English is limited and that you might not recognize "cute" humorous suggestions. Forget that "suggestion." Do NOT quit claim the road!
