An applicant in Indiana showed a Pending level-5 felony, Domestic battery with bodily harm. Jury trial is scheduled for April.

This guy looks very familiar with the laws. I just don't want him to come after me.

Can I deny him for the pending Felony? What reason do you guys give when someone has pending felony?

You can deny on someone who poses a threat to you or other tenants...but I wouldn't want to go there either. It is a pending case and who knows the other side of the story. The other party could be vengeful. Happened to a male friend of mine.

You can always find a reason to deny, tell them their application has been denied, do not give them a reason. If they inquire as to why tell them managements policy is all requests must be made in writing, send a self-addressed postage paid envelope along with the request. I have never gotten a request in the mail in the 2 years I’ve handled it that way, others on here have been doing it that way longer than me and also never received a request in the mail. --174.196.xxx.xxx

In line with Ken's thinking, a good standard policy may be to tell applicants that they will be contacted if their application is pre-approved (pending in-home visit).

Possibly even give a time frame, like: screening is typically completed within 2 business days. --68.229.xxx.xxx

Let him know that you are aware of a pending legal matter that should get resolved before they move in.

After the issue is resolved and that they proven innocent, they are welcome to look at any place you have available at the time. If however they do get convicted, it is not your policy to rent to people who commit acts of violence without waiting at least X years.

Never....ever....offer a reason for denial. Every cop show you've ever seen contains these words:

"Anything you say CAN and WILL be used against you..."

The obvious solution is say nothing. I send an email:

"Unfortunately your application cannot be approved at this time. If you would like more information, please mail a request along with a self-addressed stamped envelope to PO Box 123, etc.... Allow up to 6 weeks for processing."

I have to disagree with you......

Just because you are charged - that is not grounds for saying NO to an app automatically. It means I can't complete the screening.

It only takes one person not to get charged or have the charges dropped and suddenly - you are at fault.

I do agree with the end result though. If he is beating someone up, and they elect NOT to push the charges (which happens a great deal in DV).......you still REALLY don't want them. (so we are in agreement there too), but I would be afraid of them trying to take advantage of the rich landlord who wasn't fair.

If the screening standard is no crimes involving violence within the past say 10 years........just hold the app until it is all clear. Feel free to rent it out to the next qualified person who isn't smacking his wife around.
