Heads up for all Indiana LLs.

I confirmed today that the new limit for Small Claims court has been raised from $6000 to $8000 as of Jan 1.

Also, eviction case numbers will start using the code EV, no longer using the SC code.

I also confirmed the CDC moratorium only protects the persons who complete the Declaration form

AND...

the CDC did NOT say it cannot be challenged by the LL.

Now you know :)

Just had a Writ of Possession Signed by judge. Took 10 days but now goes to Sheriff for service.

We have changed company guidelines to no longer give notice sheriff is coming. We did this to get the tenant to move on there own knowing he, sheriff, will be there in a few days.

This tenant did not answer the Dispossessary from the get go.

We also have 1 case pending where a consent was entered into. Once the judge signs off we will file writ due to tenant not following agreement.

Follow-up...what if they do the declaration form AFTER you file? Of course you can still have the hearing and contest I guess. --99.92.xxx.xxx

Hoosier,

First, study the CDC form and know the 5 points.

Build a case to prove they lied

-call the aide agencies to see if they applied

-require they show where they applied for work

-show they never made a written payment plan with the LL

OR that they did not do the plan.

Notify them you have proof they lied on the form and that can put them in jail and settle out of court.

Worked for me.
