Well we went to court yesterday. Lots of hoops to leap. I now have to collect my paper work from Small Claims after filing and being assigned a court date, make 3 copies for each person listed, and then take to Sheriffs Dept for service. Sheriff Dept has an office in court house and they used to pick up evictions each day, but no more. I took the paperwork to the Sheriffs Dept but they would not accept in person due to COVID, so I had to spend $20 to go to Post Office where I was exposed to a bunch of people and send by certified mail.

We went in one by one at trial. The Tenant had filed a continuance saying she had COVID. She tried to convincingly cough during hearing as she testified by speaker phone. I bet she was smoking too much meth. She has taped blankets over all windows and curled into a ball. Posting on Fakebook multiple times a day about wanting a love life. All in vain, the judge did not even bat an eye as he evicted her. I get possession 9AM Monday.

I am pretty sure she will not leave. I told her by text right after hearing I would be at the unit Monday AM and asked her if she needed boxes because I volunteer at an animal shelter and can get lots of boxes.

She said, "Yes please" . Yay, first peep out of her. She now has about 15 nice boxes. I am dreading having to ask for a Sheriff's set out as all she will have to do is say, "I HAVE COVID"

I am glad for you at least your able to get possession. I had to do some type of stipulation and grant a few free months to my tenant here in friendly CT, where the courts are closed for most eviction matters. This was a serious nuisance complaint (and of course they are not paying). I will pursue small claims when they are finally out. I send bills each month with the past due amount growing and growing. Once my bad tenants are out, I am putting on market for sale. My agent has someone already interested. These are very strange times indeed for us. --70.168.x.xxx

Good for you getting possession!!! There has to be a way to force the sheriffs hand to do what he is supposed to do regarding this.

Great job, Lana! That is awesome!

Extra great that they set it for Monday! Around here, even if you succeed in court, they always give them 10-14 days. And even that is just until you can schedule with the Sheriff -- which often adds another week!

Now we'll have to see if your Sheriff's Department will do their jobs or not...

keep us posted. Yea Sheriffs deal with this STUFF every day who they kidding about not working? now is when we need them to do their jobs --- ditto for courts.

One nice thing about telephone hearings- they can “appear” from their bed!

Is this the same judge who added rules earlier?

Wishing you luck that she vacates peacefully.

It’s a shame they add so many steps. Mine is similar. Might be orders from the state level.

I still do not understand why the court (and your sheriff) will not allow me to drop off papers with the door guards but require we mail it, so it can contact 50 other pieces of mail and touched by many more people. A more sanitary path would be from my desk to their guard.

My last next day mail envelope took 4 days to go 50 miles.
