Not sure the legality of this but was just informed that the 7 year old classmate of one of my friends has not been on his online classes the last few days. When the teacher said that they had missed him he said his family was behind on rent and the landlord changed the internet password. I have no idea what type of housing situation this is but am curious what your thoughts are on the legality of this? Is internet these days considered a utility like water and power? The more I see how some landlords operate the better I feel about how I operate. --64.252.xx.xx

I was reading something last month. And was surprised to see it was now considered a essential service. Even the government is trying to pay for it.

I don't control any passwords for any of my tenants so in this situation, the internet is set up differently that I know.

taxpayers in NJ and cell phone users and internet users in NJ have been paying govt. surcharges for connectivity for all for many years. It's usually a buck or two. Very annoying. All seem to have a cellphone and some are very large and fancy. Saw a guy at the foot doctor office who had one so new it was not available to others yet. Gosh, I feel like this place is turning into, in some ways, a bunch of landlord apologists. When will people in society have to accept that there are consequences for their actions? There's more work available than ever. I have to watch what I say around my help, because if they realized this, they'd say - hey, #22, costs are going up and you can't find someone not on drugs to do the work we do, so we need a 30% raise. And I'd probably have to give it to them... it sounds like priorities in their household were consumption over paying obligations. It's a sad example to set for the child, it's not their fault their parents are the way they are. In fact, he's bound to repeat their faults. Kid could hang out at library and use that internet, or any local coffee shop or other place where hotspots are available. It's a parent issue, not a landlord issue.

Yes, technically phone and internet and cable are considered utilities since they're fed to the house from a common connection like gas/electric. However they are not critical.

It all depends on what is in the lease agreement. IF the LL CONTRACTED to provide internet, then he is obligated to provide it until the eviction. Not morally perhaps, but legally.

Another angle to consider, is he LEGALLY sharing internet? Is it legal to run a wifi booster from your home internet and broadcast to a whole neighborhood? Or do you need to pay for a commercial internet account to be able to become an "internet broadcast provider" for your Tenants ? --68.202.x.xxx

Well technically - I suppose the internet wasn't turned off.....the access to it was denied.

Punishing a kid - because mom and dad are idiots sinks that LL down to below the level the gvt is using. Yes the child could contact the school district - but in the end with that solution it ends up being the property owner who bails out the kid.

If this is indeed LT issue, this item would have to be listed as a service provided by the LL in the contract - it is a breach of the contract. If a service is a utility or not doesn't matter if it was promised.

In 1946 the Supreme's made this call about private businesses. Today this has more meaning then you know.

I'll use the example as was heard with my own ears.

When as a private business or person you build a bridge to your place. People start using that bridge. YOU CAN'T ARBITRILY close the bridge once people get use to using it.

I fully support the Landlord on this. It is bad enough when tenants dont pay their rent for 6 months and then get an extension that prevents the landlord from evicting them. Now we want to demand that the LL provide internet to.

Well if you support this, shouldnt all the tax payers be obligated to providing the homeless with free internet as well? Why should the 7yo children of homeless suffer?

When the person pays rent, it pays for access. When they fail to pay rent, they quit paying for access.

It is reprehensible to me that the govt expects private citizens to house people on their dime. If the govt wants people housed with out paying, then the govt should pay the rent for them.

Since we know we can' take things like this into our own hands (storm the legal system) it requires a court to decide. That's the big problem since the courts are in bed with SYSTEM they help create.

I was told early on by an attorney that if the user gets on illegal sites, such as child porn, or conducts any drug-related activity, liability the one who the internet is licensed to. Therefore, I have not, and will not provide Internet use as part of the rent. I would sooner discount the rent for someone to pay their own (which I have not had to do) than provide it.

That said, countless cafes and coffee shops - even grocery stores - often offer free internet, so who knows. --69.130.xxx.xxx
