When answering via text inquiries about advertised houses, I will be asked about pet policy. I then send via text $150 non refundable animal registration fee per animal+ $35 per mo per animal. At this point, I will oftentimes receive a text asking - what if it is a support animal?

Nowadays, I send a reply that assures them that I abide by the law and a request for letter from their physician describing their mental state and verification that an esa has been prescribed.

I have yet to see an application from anyone who asked the Q -what if it is a support animal?

My question to you is about their Q to me.

Are they trying to get me to incriminate myself?

Pick a fight, and rant & rave?

Save a few dollars?

One of two things:

1) Testers

2) People who are checking to see if you will just accept it as a support animal with no documentation.

IMO, 2 is more likely. I know testers are real, but there are far more people trying to sneak pets in as support animals than there are testers. --98.174.xxx.xxx

We don't take pets at this property due to new carpeting. We will have another similar property coming up and I can list you for that one. That one allows pets.

I tell them this is a legal issue. I am not a lawyer so I am not allowed to offer legal advice. They have to figure the paperwork on their own. In Indiana, I also get to tell them that they are breaking the law with potentially severe legal consequences if they misrepresent an ESA. So they better get it right. --107.141.xx.xxx

I agree with Scott's answer. Ask any lawyer and they will say most people screw up when they fail to shut up.

If someone asks about ESAs/therapy/support animals, etc. I basically say, "We follow all federal, state, and local laws."

It's up to them to know what their rights are and take the proper steps. It is not my job to offer any advice on what they need to do or have a right to do.

I think the ESA days are numbered with the recent airlines ban. That's definitely a perk for us. I've had many pets become ESA's after the prospect find out theirs monthly fees. --70.44.xxx.xx

I always ACT AS IF this is a tester.

EVERY WORD spoken or texted might come back to bite me so we do not discuss. We act on what THEY provide on the app.

LLs are sued for what they SAY so we don’t SAY.

Our standard reply is “Most properties allow animals. Everyone is welcome to apply.”

If they press we tell them to “include all info on the app.”

We do not even HINT yes or no or docs or nothin! Decisions are made AFTER we review their paid, written application. If they mention support animal and their app is pre-approved (90% of data is confirmed and approved) we tell them the next step is to go to our link on PetScreening.com and let PS deal with support animal issues.

In a sit down meeting with the local Fair Housing director and again when she presented to our LL assoc, she confirmed the recent law allows ask for additional information when presented with support animals.

She also suggested we not tell them what to provide because legit support animal owners HAVE a Letter of Medical Necessity, the only doupcument SHE will accept.
