Are unauthorized occupants protected under the Connecticut eviction moratorium? I have a tenant that moved in a boyfriend who would not be approved based on his criminal record. My lease states that additional occupants must be screened and approved. --73.142.xxx.xx |

You can try. Lease violations are not supposed to be protected, but it is going to depend upon whether or not your local judges are using the bench for social engineering.

I have not yet given them written notice. The CT moratorium does not specifically mention lease violations and I don’t believe this is considered a “serious nuisance” by the State:
Landlords are only permitted to start an eviction action if a tenant:
a) owes rent that was due on or before February 29, 2020;
b) owes six or more months’ worth of rent that was due on or after March 1, 2020;
c) created a serious nuisance; or
d) has a lease that expired and the landlord has a bona fide intention to use the unit as the landlord’s primary residence --107.242.xxx.x |

"Primary residence" has no legally defined length of time, to my knowledge. Nor does there exist any defined standard of how much furniture must be present. I imagine sleeping accoutrements (ex. a cot or air mattress) and food in the fridge is a basic minimum qualification.
Check with your attorney if unsure, but I would really like to see someone argue what "bona fide" means in this instance and whether or not it could be used against you if you changed you mind shortly after moving in. --107.216.xxx.xxx |

File and don't reference the non-payment as a reason for eviction - just the unauthorized room-mate.

Hopefully the moratorium won't go past 2/9. Lamont knows it's getting time to open back up. Call the clerk at your courthouse first. The notice to quit has to have CDC information. Not sure about other states, but in Virginia the property owner can call the police and get anyone not on a lease to be removed from their property. The police will also give them notice that if they are caught on the property again it is considered trespassing and they can be arrested for it.
