MYOB, getting a financial judgment for back rents, damage, etc. is very difficult in NC. If the tenant doesn't show up in court, at best I get possession.

So turning over the amount owed to a collection agency, or reporting it here through the credit/collection agency is the only way to publically ding their credit. --50.82.xxx.xxx

Not trying to damage them just to be mean. The owe 7 months of back rent,..again not Covid related but because of Covid the courts here are way backed up.

Actually I don't want to do it rt now,..as it will probably keep them from moving. But I'm thinking if I time it rt, perhaps another LL will be aware of these people.

WMH difficult-- that's BS. It's always difficult any where.

You can say they owe you for the Brooklyn bridge but without EVIDENCE-- IT'S YOU SAY THEY SAY. Should THEY GET DENIED FOR Something based on your report to the Credit company AND YOU DON'T HAVE THE PAPERWORK-- YOUR GUILTY NOT THE Tenant..

WMH I know your state and some others you can't collect-- but you can get it on the court calendar-- get your day in court. Let this stuff follow them around with a case number attached.

Here in GA when i look at a C/Report and see judgments-- you know what i say-- awe just another LL who didn't know how to collect-- who didn't garnish. Then we step in and were #3 on the report-- but guess what-- we have garnished and now every LL out there can see it on their pay stub. Others will have to wait until were done before they can get there money-- we moved tot he head of the line. See it every day. --99.103.xxx.xxx

If a tenant left you at the stoke of midnight without paying all of their rent, you have no proof to show a credit reporting agency the tenant did anything wrong. So reporting a non verified debt won't dig a tenants credit by much.

However if you got an eviction and also got it converted to a money judgement that would be verifiable. But after the time passed where you tenant could no longer file an appeal, then I'd record the Judgement with the County Recorder and alert the credit agencies about this. Then it's official, your x-tenant skips out on debt, lost in court and had a court awarded judgement. This will kill their FICO score. Something like 100 points. From Good to Terrible not worth the risk....

Or I file, like using Mr. Landlord, and have them do the paper work and get it reported. --47.155.xx.xxx

Thank you guys,..According to 3 other lawyers that other LL say are good in RE matters ,we have what they say is the best lawyer around for evictions working on trying to get them out,..it hasn't been thus far quick or easy,.. --66.30.xx.xxx

WMH, in NC many landlords file for possession first, then file at a later date for back rents, damages, etc. Thus, there are two court dates. When going to court for back rents, damages, etc., have all needed documentation, receipts, photos, etc. prepared. That information is more difficult to have when a tenant is still in possession.

myob, as of summer 2017, as a general rule, none of the big three credit bureaus report judgment. This was a result of some consumer advocacy action. If judgments are still showing up in the credit reports that you are seeingfor Georgia, it may be because they were picked up prior to 2017 or because the applicable courthouses in Georgia are providing the additional data that the credit bureaus now require to report judgments. Even though NC does not allow garnishment, you provided a great tip to look at pay stubs for garnishment. I think a narrow path for garnishment is allowed in non-garnishment states if the employing company is based in a garnishment state.

You can report to the credit bureaus without going through contingency collection by using rentrecoveryservice dot com. A judgment is not needed. If you go this route, you will have to keep the credit report updated. Using the Mr. Landlord service allows you to report to the credit bureaus without having to also update the credit bureaus because it automatically rolls over to contingency collections after a certain time period.

I have not had former tenants pay solely because I reported to the credit bureaus. I have had them pay because I have both reported to the credit bureaus and sought a judgment. I second myob in recommending being systematic in your approach to doing collections. I think myob said in another thread that he also was contacted to come to court for a judgment after he had turned his collection over to an agency. That may have motivated him to do his own.

Shop around for attorneys. Since NC is a non-garnishment state, there is a difference between an attorney who can help get a judgment and an attorney who specializes in collections once you have gotten a judgment. It can be useful to use different ones at different stages of collections. An attorney who specializes in collections should have access to resources that you don't, and at reasonable rates.

You can pursue a judgment yourself without an attorney if you are comfortable doing so.
