We have a tenant that refuses to break down cardboard boxes and other trash or to use recyclable bins. Just a few large boxes and the dumper is pretty filled so the other tenants can use it, They often set out bags outside and we get charged extra and warning that we may lose the service .

Sent several notices. They are not friendly and for a number of reasons we are trying to get rid of them but our supposedly good eviction lawyer says that he can't do anything with the courts backed up.

So I'm thinking in this 4 plex that we can put a lock on the provided top bar (to lock it) and give the other three a key.

But I;m guessing they will just put their trash outside of the dumper. Any suggestions of what to do with this situation? --96.236.xxx.xxx

Remove the dumpster. Get a service that gives them each a standard sized barrel. Label one for each unit and provide locks. Set up a camera. If you have to bring in someone to clean up after them, they get to pay for it. It’s better that way for move outs too. --174.242.xxx.xx

Been there done that & got the Tshirt to prove it. Tenants in my multis who don't recycle properly & put non house hold trash in the rubbish are my biggest pet peeves. The only semi successful way I've found to combat this is to go thru the rubbish & look for some identifying mark in the trash. If I find anything that proofs who did it, I bill for any extra costs involved with dealing with the problem. If you can't accurately determine who is the culprit, you may have to install a game camera or install some kind of video surveillance system to catch them.

What does the lease say about the duties for trash and trash service? If you are saying a specific behavior set is costing you money - it is time to follow the lease and see if it is legal for you charge the surplus charge you are getting to the Specific repeat offender.

+1 to Ray's advice. The only way I've found to change recalcitrant tenant's behavior is to back bill them for the extra charges. I forget who coined the term, but "Wallet Training" is effective, or they move. Either way, you win!

Well we don't do leases only month-to-month. Unfortunately it is not addressed in our month-to-month rental agreement.

As far as getting rid of them, we can't,.. the courts are not accepting any cases and our governor has extended the moratorium for covid.. And these people are leaning on that in order to not pay any rent for 5 months now.

One tactic I thought about is that the top does have a bar which can go across to lock it. My thought is to give the other tenants a key to the lock with a warning that if the share the key with anyone else (in the building or out of the building) that they may lose their trash rights also.

The problem is I believe we are required to provide a dumpster, I don't know how it might work if we restrict their use to anyone. The only place that we could put barrels is not practical. And chances are they wouldn't use it anyway but just put plastic bags all around it. I have a feeling that they may be using our service or other people outside the building, friends or relatives that don't have trash pickup. --66.30.xx.xxx

One of the problems with a dumpster is people who do not live in the building dump hazardous waste like used engine, lead acid batteries, tires and electronic waste which is not allowed in dumpster. The spring time is the worst time where a clean up then it is over to a dumpster instead of driving to dump where they have to recycle. If the dumpster is not visible from the road then amount of illegal dumping is minimized. Even if a temporary fence which can mounted on wheels so when truck comes in to empty will reduce the amount going into dumpster. Found by removing cardboard then compressing the remaining garbage went from every week to once a month to empty. --99.236.xxx.xxx

I have a similar problem. My lease has a provision at my multi that is building wide. All (3) units are charged a $10 fee regardles who the offenders are. The town charges the owner and in return I charge the tenants --172.58.xxx.xx
