I am not very familiar with Indiana Law.
My lease says no smoking on the property. Can I deny renting to smokers altogether in Indiana?

It’s part of my prescreening. I ask how many smokers will occupy the property and if they smoke inside or out. If they specify any number other than zero, they’re denied.

I won’t rent to a smoker, if you are worried about it deny for another reason. This thread and Jeff [CO]’s recent thread “lease violation 1st day” reminded me of a prospect I had years ago. He was told it was a non-smoking property, and assured me he didn’t smoke. He called during the screening process asking if it would be ok if he kept his motorcycle parked behind his vehicle, I told him I’d allowed it even though he was told only 1 vehicle per tenant on the lease. To thank me he asked if I smoked cigars, he’d like to give me a couple Cubans. I told him I don’t smoke, he then replied “I like to have 1 after dinner”..........denied.
