State Specific Question About: NEW HAMPSHIRE (NH)

I'm putting my side by side 2 family up for sale Jan. 2. (I can't wait) I have a tenant that doesn't even want me in to fix a toilet. Can someone tell me what rights I have when showing it and what rights does he have?

barring no funky laws in NH, you have the absolute right to list and sell the property. He has the obligation to allow you to do so.

How that works in reality is very different if he won't cooperate. Get him out and then list the property for sale. --72.70.xxx.xx

Post the door with 24 hour notice for showing but if they are adversarial it will be an issue. The first building we bought the tenant they were evicting claimed to have a communicable disease and wouldn’t let the inspection take place. My MIL was smart enough to write our P&S to read we would take possession after the eviction was completed with tenant removed and the unit rental ready. They agreed and then didn’t hire a lawyer and messed up the paperwork so it took at least an extra 3 months to close. --73.17.xx.xxx

As a LL we have an obligation for quiet enjoyment so viewings should be at reasonable hours and under reasonable conditions.

You also have an obligation to maintain the property.

PROCEEDINGS IN SPECIAL CASES

CHAPTER 540

ACTIONS AGAINST TENANTS

Section 540:2

540:2 Termination of Tenancy. –

I. The lessor or owner of nonrestricted property may terminate any tenancy by giving to the tenant or occupant a notice in writing to quit the premises in accordance with RSA 540:3 and 5.

II. The lessor or owner of restricted property may terminate any tenancy by giving to the tenant or occupant a notice in writing to quit the premises in accordance with RSA 540:3 and 5, but only for one of the following reasons:

(a) Neglect or refusal to pay rent due and in arrears, upon demand.

(b) Substantial damage to the premises by the tenant, members of his household, or guests.

(c) Failure of the tenant to comply with a material term of the lease.

(d) Behavior of the tenant or members of his family which adversely affects the health or safety of the other tenants or the landlord or his representatives, or failure of the tenant to accept suitable temporary relocation due to lead-based paint hazard abatement, as set forth in RSA 130-A:8-a, I.

(e) Other good cause.

(f) The dwelling unit contains a lead exposure-hazard which the owner will abate by:

(1) Methods other than interim controls or encapsulation;

(2) Any other method which can reasonably be expected to take more than 30 days to perform; or

(3) Removing the dwelling unit from the residential rental market. --73.61.xx.xx

A hostile tenant will make things nearly impossible in terms of a sale. If you're trying to sell the place as a rental property with tenants in place, then you may need to provide some financial incentive for the tenant to be cooperative with showings. --96.245.xx.xx
