I wrote to a key local eviction lawyer expressing my concerns about the moratoriums, His response follows:

Your analysis is spot on correct and I agree with you 100%.

We have thoroughly analyzed lawsuits in federal court over both the CDC Moratorium and the Governor’s various executive orders. We spent about $40,000 on outside attorneys (good ones) to review all the relevant cases coming out on the subject and prep litigation. NAA actually filed suit on the CDC moratorium.

One would think that these moratoriums represent clear constitutional violations against property takings without compensation, the free-speech right to redress grievances in court, due process and equal protection clauses. The half a dozen or so cases that have already been decided since the enactment of the moratoriums have all consistently been against our position. The cases have consistently found that since the moratoriums are temporary and they don’t extinguish the property owners’ monetary claims against the resident, they are not constitutionally prohibited. That’s certainly not the way I read the Constitution.

I think the judges haven’t understood that something is not “temporary” if it can be endlessly renewed and that the value of a claim for possession of the property is mathematically far greater than the limited value of a collection claim against the tenant after they’re out of the property. Also, the courts have really bought into (as have about 75% of the population) that this particular strain of respiratory influenza is a grave emergency and very unlike all the infectious diseases that have come before it. Until the underlying panic subsides (and it seems to be getting worse not better) I can’t foresee that anyone is going to convince liberal policymakers that these extralegal executive decrees are the problem that they are.

It also doesn’t help our argument that overall collection rates remain so strong (but 95%). Of course that works out just fine for a large operator with a diversified portfolio, but is meaningless to a small owner operator that has a resident in default. If we find a small owner that’s actually suffering foreclosure, our lawyers think we might have a fact pattern that would lead to a different decision, but thus far we haven’t been able to find someone in that dire of a predicament. --76.120.xx.xxx

When the availability of rental housing dries up and there is less affordable housing if any available housing at all I won’t have any pity except for the good quality tenants it will affect.

Exactly DJ! They haven’t told food markets they must continue to give food away to those who cannot pay just by saying well, they still owe you the money for the food you supplied to them. Because that would be insane.

Yes, businesses have been forced to close. Yet they have a choice whether to hold on to the business or sell it. They can choose not to fix the air conditioner or water heater until they decide what to do. They aren’t being required to continue to service their customers for months on end for free.

JAC, the destruction of the family is the greatest destruction of a safety net there is. Government handouts have done a good job there. In the post by plenty about the tenant who hadn’t paid rent whose landlord removed the door you can bet without the moratorium which told her she could get away without paying and stiff her landlord she would have simply relocated Next door with her mother until she could afford to live on her own again. But why should her friends or family help her her when the government has told her she can live in her own apartment without paying?

Who needs to plan for your own safety net when the government is there to cure your woes at someone else’s expense?

Wouldn't it be nice to get the landlord’s side of the story and learn what lead him to the decision to remove the door? Maybe he knows she is working. Maybe she had lease violations in addition to not paying. Maybe she’s ignored all attempts at communication. Maybe he got disgusted when she bought a new big screened tv. Maybe she refused to cooperate when he was trying to sell the property which apparently is being sold. --75.89.xxx.xxx

It comes down to the state courts deciding what to do. I was FORCED to give a tenant 8 months free rent this year because under the guise of C19, our courts closed. Then when they finally opened in July, The judge told me flat out if your still filing for rent or end of term it will be continued at that point would have been the 9th continuance. I finally got smart and changed my plea for violations. Luckily the neighbors had complained and that helped in the judge awarded possession or I'd still be giving away rent. This year Was a total loss for that property. Yes I finally got rid of them but zi will get nothing for it. --24.115.xx.xxx

Well nothing prepared us for the CDC going rogue and imposing a nationwide moratorium. I did not know the CDC had that power and I will assume they simply took it. I think it will get much much worse with Socialists in control. Look for a year long moratorium on evictions or even a rent moratorium. Grocery stores are big corporations, so nobody is going to hurt them. Utility companies? Look for new laws making all utilities the ultimate responsibility of the Landlord.

JAC no such thing as fair when it comes to taxes. It starts at the source: why should the government has such ever-increasing budgets that to NOT spend all of your agency's allotment is a bad thing? The incredible wastefulness of the federal government is breath-taking. The fraud and cronyism is mind-boggling.

My goal is to legally pay as few taxes as I possibly can. To give more than required is silly, they will only waste it. --50.82.xxx.xxx

You hit the nail on the head. That’s exactly how it works. I worked in government for a number of years and saw this time and time again. The goal was to spend all the money budgeted for and then some to justify a larger one the next year. I was in disbelief once when an organization I worked with once sent and employee out to buy stuff at the end of the fiscal year, computers and other electronics. The office had the most amazing 35mm camera I ever saw (no use for it but he was told to spend the money). They simply couldn’t t have any left and chance their budget being reduced next fiscal year. We reward the wastefulness and there is no accountability. That is less likely to happen in the private sector. --75.89.xxx.xxx

Report it to who? It’s the way the governing budget system works..use it or lose it.

I was crestfallen when as a young captain in the army I wanted to send my office members to some training which would benefit all of us. This included two military members and two civilian government workers (2 women and two men). I was told only two people could go due to the travel budget which would have to cover air fare, a rental car and two hotel rooms. So I arranged to use a military van from the motor pool (saving on air fare and rental car) and the four people agreed to share hotel rooms. Commercial air fare is always higher because it must be fully refundable so you can’t opt to buy cheaper flights.

I was able to send four of us to the training (distance wasn’t far, North Carolina to Virginia) for less that the cost of sending two folks to the class the regular, preferred way. I was so proud of myself! Until word got out and I was reprimanded, scolded for doing what I did for fear it would set a precedent and affect our future budget. True story. --75.89.xxx.xxx
