A tenants has a new pair of glasses and since she doesn't have to work due to the pandemic, she loves to read stores about tenants not having to pay rent. And how the Los Angeles Housing Department requires Landlord to furnish tenants with "Notices" explaining how tenants can get out of paying rent and delay repayment for 1 year!

So this poor tenant who can't seem to pay me her rent has a new leased car. I explained that her lease provides for only 1 car on the property, parked in her assigned numbered spot. She can not park 2 cars on the property.

So I was able to give her 15 Day Notice to Perform or Quit -- evict her for having a second car parked on the property, a lease violation.

So the tenant parked her new car in front of the neighbors property. She didn't bother to re-register her old car, it need to pass a smog test. So without tags, if she parked her old car on the street it would be towed.

So the neighbor didn't like my tenants car in front of her home and called "Parking Enforcement". Parking Enforcement recorded the day, time and exact spot the car was parked. Then 72 hours later write a ticket for parking over 3 days without moving her car. Then Parking Enforcement called to have the car towed to an Official Police Garage.

My poor tenant, with two cars and hasn't paid rent in months calls the police thinking her car was stolen. They informed her that it was towed due to a parking violation and the:

City of Los Angeles is charging her $100 for the towing and $50 for the parking violation. And on top of that the Towing Company is charging $100 for the towing and $25 per day storage.

So the City/Government is making out like a bandit, getting $250 from this tenant and using her car as leverage. But me the landlord can't get the rent...This tenant also owns a home out of State and in Mexico too.

The rules are an owner of an apartment property can not allow a vehicle to park in the open if it isn't currently registered and operational. The tenant has to be given a 30 day notice to comply.

The moment you give a tenant any type of notice, they will call Housing and file a complaint against the owner. The if an owner moves to evict, the city calls that a retaliatory action and then the tenant's eviction case will be thrown out.

granted, the California landlord tenant world you appear to live in might as well be on a different planet than the one I exist on so perhaps I misunderstand, again.

If you gave her a notice to "perform or quit" and the city towed the vehicle, she has "performed". So how do you now get to evict? --72.70.xxx.xxx

I'm sorry I didn't make myself clear. I can issue a tenant a 15 day notice for a lease violation not involving unpaid rent. However during that 15 day period if the tenant moves their car or complies with the lease, then I con not evict. --47.155.xx.xxx

Could you not prove that she has a newly leased car and so she is just playing the no rent game?

I thought they had to show proof that they could not pay rent due to COVID and that they had tried to get rent assistance?

There are so many ways a tenant can legally skip out on paying their rent in California through tenant protections. The only protection a landlord has is if they can prove the tenant is still making $100,000 or over annually.

A tenant can say:

a) I lost my job

b) My hours were cut back due to the pandemic

c) I care for someone

d) I have to watch children, school is out

At this point, just about everyone can say the job was impacted by COVID.
