So tenants are telling me that they are using heavy equipment to bust up the road and sidewalk and the old brick building is shaking a lot.
They are say there are big cracks in the plaster and the top floor lady is saying the ceiling is also cracked and she is afraid it might fall down (however she is a real drama queen and prone exaggerate)
So do I have any claim to the town or my insurance to cover any real damage? --96.236.xxx.xx |

Don't discount what the lady is telling you about the ceiling. When I operated my const company I got a call like that. I went and checked it out. The lady was sitting on her bed and the old plaster ceiling over it was obviously loose with cracks. As trucks went by on the street I saw sand grains falling so I got her up and out of the way. Less than a minute later a piece about 6 feet around fell and landed right on the bed where she was sitting. It weighed about 100+ pounds and would have hurt or killed her.
A small crack can be patched but once the cracks join together or zigzag in a larger area, it's time to replace the ceiling. --75.7.xx.xx |

I think that you need to put eyes on the alleged problem ASAP. Once you've confirmed that there really might be an issue then contact the city / town manager / selectman/ administrator via phone & Email. if you can't reach them tonight then put a call into your Police Department via their non emergency line.
Personally I doubt that any type of normal road or sidewalk work would cause a sound building to have a problem. --71.174.xxx.xx |

I collect evidence of who causing what damage. Then I give them warning they are causing damage and will have to stop that method of demolition. If they refuse to stop, I will call 911 emergency and request the police and someone from the fire department to view the damage.
If that doesn't work, I'll have my attorney file a cease and desist order.
I have stopped construction of projects next to my various apartment buildings that borderline commercial properties. In one case the owner lost over $100,000 in downtime costs. He then tired to sue me. But since he ignored my warnings, I had the right to take it to the next level.
My father and myself got a shopping center project stopped for violation of zoning. This was near to a property we own together. The developer spent an extra $765,000 re-working his project to get it finished.

Along with your evidence, find out all parties involved. Sometimes cities put a project up for bid and an outside company or companies do the job. You then want to have the insurers of those companies, pay for the repairs and whoever hired them.
In our neighborhood, one house away from ours, an old water tower was torn down and replaced. They disassembled the heavy steel tower large piece by large piece from at least 200-300 feet high. It shook the ground like an earthquake, was very loud and went on for days. All our walls ended up cracked, and the foundation as well. We had just painted the entire lower unit for an incoming tenant. There were at least 3 contractors working on the project. We were able to sue 2 of them for a small settlement. email and call your municipalities engineers office. You will probably not be able stop the work before more damage is done, but you can document the damage this way (pictures help). If you want to more pro-active then get your own engineer over there today. The engineer can take readings and put sensors on your building and record the shifting. Contact the neighbors and see if they have similar damage. If they do contact the local politician and ask them to intervene (they love stuff like this hopefully). --24.194.xxx.xxx |

I echo the advice to check it out asap and document as much as possible. Photos, video with sound.
Also, if they have the ground open it may affect drainage. Eye up the drainage paths to see if you'll likely get water in your basement or foundation. I know you don't want to hear that it is time to pony up and update lathe and plaster walls and ceilings. When not updating a unit is endangering anyone - you really need to act pretty quickly. At this point you are liable and you have knowledge of something being wrong.

The people in the building said it felt like earthquakes for days, The walls and ceilings were in good shape, neighbors in nearby buildings also complained , but we had the construction by far the closest to the building.
