First thing is don't use your real name on a public forum such as this.

Unfortunately it sounds to me as though you might have already "screwed it up." If their rent is due on the first of the month then you have to give them at least a full rental period notice. Basically this means that in order for the notice to be valid for a November 30 termination, you would have had to given them the notice on or before November 1, 2020. Was this 30 day notice intended to end a MTM tenancy or a term lease? When & how did you serve them the 30 day notice? Can you prove when they actually received it?

During my time as a MA LL I've evicted my fair share of tenants. The only time I ever used a lawyer was for my very first eviction over 45 years ago. That being said if I needed to do an eviction under the current eviction "hysteria", I would definitely be talking to my lawyer.

How is title to the property held?

Have you ever done an eviction representing yourself?

Do you have an attorney that knows MA LL/ Tenant laws?

What part of MA is the unit located in?

Chalk me up for a lawyer in these times, and the costs will most likely be added to the judgement.

One thing I have noticed in my almost 60 years is that a lawyer often makes a big difference any time you go to court. To the Judge, it shows that you are a professional, and take the issue seriously. Also, the judge may not know you, but there is a good chance that the judge knows the lawyer you hire. --108.39.xx.xx
