Advocates already are pressing Pres-elect J B to sign a broad, new national eviction moratorium on his first day in office. They want B to work with Congress in his first 100 days to pass a relief package that includes at least $100 billion in emergency assistance for renters and landlords and resources for the homeless.

“By the time Pres -elect B takes office on Jan. 20, we may be in the midst of a historic eviction crisis in our country if no action is taken between now and then,” said Diane Yentel, president of the National Low-Income Housing Coalition."

As a small landlord who limped across the moratorium finish line in 2020 still having my shirt, this is the first I've heard of this new housing ultimatum.

Does anybody know what the terms might be of a B National eviction ban, and how likely it is to pass? Could it be all of 2021, no evictions for nonpayment of rent?

Will they be the typical shotgun-barrel government moratorium, good luck collecting rent, no guarantees government aide if and when we approve it?

I doubt the Senate lets any $100 billion rental assistance bill go through in any case.

I have to say the idea has made things extremely discouraging/risky for me to continue. I don't have the capital to carry nonpaying tenants, so this may be game over for me :(

I would encourage landlords to contact/talk to your representatives about this asap while there's still time :/

I am in the long three month process to evict tenant for things besides "non-payment of rent"! Such as leaving food out and attracting roaches. Parking in an extra car in a fire zone. Having a dangerous pet that attacks any living thing like other tenants and even the tenants roommate. --47.155.xx.xxx

Until this expropriation is challenged in the courts as this unconstitutional then this madness is going continue. Suppose they forced the grocery stores to provide free food, marijuana for all those needy tenants then in short time the grocery store would close down then the workers would be out of work. Most jurisdictions people are receiving funds for food and housing where there should no reason not to pay rent where homeowners are definitely making mortgage payments. Here the system is backed up where it is going to take a year to get a hearing. A class action suit is easy where a large number funds the legal challenge. Landlords associations have challenged governments in past where they backed down even a year later they tried again where the same results. The radical tenancy advocates are hoping nothing legal is going to happen as we supposed be living in democracy regardless who is in power. --147.194.xxx.xx

I already did write to my reps. One responded with a canned response talking about everything covid-19. The couple sentences talking about the eviction ban said he supported it. All my reps are red too. I don't see the current ban expiring at the end of the year. --70.179.xxx.xxx

Its unconstitutional to take away people's access to the courts and due process (Amendment V). As well as mandating private property for public use without compensation.

And Amendment III forbids the government from forcing you to quarter other people without your consent.

idk. Looks that way to me. They seem to be overlooking the print.

Obviously for whatever reason they're using the Pandemic to introduce some pretty draconian big government/socialist stuff, that can easily be tapped again in the future.

I don't buy the poor old disabled lady excuse (news story). We had a Great Depression and FDR didn't mandate housing.

What's next, gubmt orders you to give your car to someone they decide needs it, and you keep it gassed and serviced? Orders you to keep working places without pay?

Ray - no, you are not. The problem with all this I'm seeing is they are reluctant to lift the eviction ban because the courts will be back logged with evictions. So, they are kicking the can down the road. When it does finally lift, the flood will be even worse. I've actually seen this may become permanent. Not sure how it could, but they can try at least. If it does go this way, it could take years to wind its way through the courts.

In my area, self help evictions, lease violation evictions and lease non-renewals are on the rise. I have to assume they are everywhere too. The news talked about how they were wanting to close these "loopholes" so LL's can't evict at all.

Buckle up. 2021 could be a bumpy ride....

My kids eight and under could've came up with a better Covid response than our politicians did. I should question them later and see what they say. Doogie, just to put this out there, I entirely support self help evictions under these circumstances. The legal system has either failed or has been made to fail.

If you have no recourse, what do you do? Get on your knees and beg and wait for something that will never be returned to you? Wait until some emperor says I grant thee permission to enter the house and remove the tenants. Wait indefinitely? Yeah right. --70.44.xxx.xx

I think B will allow KH to take a leading role on this issue, and her position is well known. The plan she proposed back in mid-July didn't get much traction in congress, but it might be a prelude to the direction the B administration will take. That plan was malevolently anti-landlord.

I think we have a long way to go until we hit the bottom of this mess in residential real estate. I'm not buying any right now unless I can turn around and liquidate it for 20%+ profit "as is", no work on my part. No more buying residential rentals at this time. Possibly going to sell some and stick with commercial, which for now at least appears relatively unaffected by moratoriums.

My hope is that there are still enough intelligent people out there that once we start to see the side effects, they will quickly change their minds on the moratoriums. Right now, all they see is "pandemic" and "fairness", but once their pensions and retirement plans--some of which are heavily invested in REITs--start tanking due to unpaid rents I am Xing fingers they will demand that renters either pay up or move out.

Land lords will suffer first, then real estate investors in general, then general investors who hold shares of any type of real estate. And tenants will have to be cream of the crop or I will not rent to them. Look for fewer rental units coming online and marginal tenants to end up crashing on couches. If we can redirect enough of the pain at the every day voter, we will see changes. --107.216.xxx.xxx

A "self-help eviction" is basically taking illegal actions to FORCE a tenant out without following proper legal channels for eviction. It can range from turning off utilities, changing the locks, dumping their stuff outside, and so on.

Again, it is illegal. NE is basically saying that he now "entirely supports" breaking the law because he doesn't like how the current laws are going.
