What legality does a tennant have when they choose not to use the fridge in the rental and then their fridge's circuit board goes out?

That situation occurred 6 months ago. Last week they called on a Friday stating there was an electrical problem in the kitchen. I called several people, and had the problem fixed by Tuesday.

They are now saying the problem with the electrical outlet in the kitchen burned out his refrigerator circuit board and wants to take me to court over his $2200 fridge. This doesn't seem legit, but I don't really know. This ever happened to any other landlords? --174.237.x.xxx

A standard electrical outlet where is 120 Vac and 15 amps maximum current not any voltage or current that is higher. It is not uncommon for a electronic circuit board to fail on any appliance or electronic device. A PCB on average costs around $300 Cdn. here where less in the Us. There should be a warranty on PCB at least for five years. A lot of electrolytic capacitors on PCB boards fail where can replace electrolytic capacitors for around $20.00 dollars. It is very rare for a PCB board to be burnt. If had to spend $1700 to replace PCB would replace fridge. If there was a problem with electrical outlet then fridge would fail immediately when plugged in. What most manufacturers do is to derate electronic components on printed circuit boards so parts fail then fridge breaks down. A front load washing machine has spider which holds the rotating drum made out of white metal where the drum is stainless steel. The stronger metal will attact the weaker metal then spider assembly breaks. --147.194.xxx.xx

I've had many such problems over the years. If the problem was caused by my negligence, then I as the owner am responsible.

In each of my units I always up-grad the duplex electrical outlets to insure plug make good contact and stay plugged in. But sometimes tenant will abuse an outlet by adding extension cord strips with 6 outlets and overload the circuit. Then when a short occurs, I can examine things to see who's fault it was. Then respond accordingly.

I'd let them know in all your many years, you've never had an appliance fail because of your electricity.

You are only responsible if you are negligent. To be negligent, you have to be aware of the problem, ignore it, and then damage occurs. In the law, this is called being, "put on notice." When you were put on notice, the problem was promptly fixed therefore you are not negligent and are not responsible. The tenants renters insurance should cover this loss. --50.77.xxx.xxx

That is why we do not provide a refrigerator in our properties they do not clean it or they break it and descent one cost over a grand. We have had one stolen and it was only 2 months old they went to jail for thief. --24.253.xxx.xxx
