I have a couple of houses I'm rehabbing for resale, while totally revamping policies, procedures, and paperwork before taking on new tenants.

Also shopping for buy-and-hold properties only in the most desirable neighborhoods. Places where people will want to live who are renting for the "right" reason. (right for my plan) For me, those are people who could otherwise qualify for something bigger, or could buy - but they are choosing to live frugally because they are saving up to buy or only in the area a few years (like military). This type have been my best tenants in the past.

Although I certainly don't like the new laws, I still don't see a better way to get a good return with relative freedom from the everyday drudgery of paycheck work.

If you landlords in much more regulated areas can figure it out, I can, too.

And so can YOU, if you really want it. Double down, focus hard & figure it out.

I see this as nothing more another yet another military deployment that I had. They get extended routinely when I was in. The unit you are deployed with is getting a bad call and an extension on top of that. It happens

This is nothing more than something that we routinely ask of our military members to pull through. So for everyone out there at this time of year, jot down a short note for someone you know who is serving. Some jurisdictions rental housing providers have already taken governments to court for a class action suit where this was unconstitutional. The extreme leftists tenancy advocates look at this opportunity to expropriate private rental housing where suppose they forced the grocery store to give out free food then a short time later the grocery store would close down then the workers would be out of job. Soon the government would stop this madness. In the province of Ontario the extreme leftist tenancy advocacy nuts state many things so far from the truth where wonder why media does not research to get the truth. The government owned rental units are not under rent control where the government is saying one thing then doing another. When a tenant went down to residential tenancy commission where he had to pay a 45 per cent rent increase or leave. One nut was talking about rental building where he could not provide a address. Bill 184 allows a payment agreement where the tenancy advocates are against anyone receiving rent period. Governments should stop funding those extremists then they would get a job like everyone else. If you are not getting paid, you should reread the CARES Act. If you still not sure, you should be probably hire an attorney.

Collectively - Instead of moaning and groaning how unfair things are, we should all be experts at QUALIFYING the folks for CARES program who are not paying us. If they are proven not qualified - then we need to learn how to present these findings to the judge.

If anyone isn't willing to do either path - I am starting to buy units again in my area --24.101.xxx.xx

CARES Act says you can't evict a QUALIFIED tenant. It goes on further to outline what is required for a tenant to Qualify.

I found myself changing my roles around from my traditional job description.

I would strongly urge everyone to talk to a HUD certified housing counselor. Learn how to make this person job easier - and in return, your life will become easier.

Now I am not saying I am singing Kum-bah-yah and everything is where I want things to be. I am only saying if you try and tackle things on your own after watching a John Wayne marathon on TV - you are going to get beat up.

I am okay with anyone beating there head up against a telephone pole. Who am I tell you that isn't the best way of doing business......I just know the number of headaches I have is down. --24.101.xxx.xx

Cares Act just requires them to make a simple declaration "under penalty of perjury". The terms are not hard for the tenant to meet and the perjury threat is not going to faze the type of tenant who is willing to pull this behavior in the first place.

This seems like ESA where it is designed to be very easy for the tenant to do. The idea that the landlord is just going to be able to circumvent this is a pipe dream. --72.188.xxx.xxx

It says that they made every possible attempt to get assistance. If you are meeting with that HUD counselor, they will gladly let you know if your resident will qualify for the CARES program or not.

In this weeks court case, I provided the judge the email saying that the tenant has broke off contact with HUD. Now I honestly prefer to get paid instead of kicking anyone out. But if the person refuses to help themselves - and you can document......I didn't run into an issue.

Now lets assume someone has shut down and you take to court, get the judgment that will probably not be collectable - you can still use that judgment. Let the resident know that you have judgment and you don't want to screw up there credit. Ask them for the keys and if they work with you - you agree not to turn them into collections and screw up there credit.

The bottom line- there is a behavior that needs to be modified. You need to inspire them to give you the keys. You may not be happy - and I am with you. C-19 has given you lemons. What you do with them is up to the individual. --24.101.xxx.xx
